Switch to Sainsburys EDF Version 6 - Economy 7 Default

I switched to Sainsburys EDF Version 6 Tarriff in early October, dual fuel and direct debit.
At the time I was with British Gas dual fuel and i reckoned on making a good saving. With British gas my electricity was economy 7 tariff but I had worked out this was costing me money. I therefore did not choose this option when switching to Sainsburys EDF on line.
I got my bill first electricity bill this morning and to my dismay found not only had the charged me on the Sainsburys E7 tariff but that those tariffs were higher than those published in the leaflet they sent me in my welcome pack last november.
On contacting EDF I was told that as I had a Economy 7 meter that this would automatically default me to the Economy 7 rate. However they offered to change the meter going forward so I could revert to the correct rate. The EDF advisor would not comment when I requested that they refund me the difference (£41 on the quarter) but insisted we concentrate on getting the meter changed.
I then questioned him on the E7 tariffs charged on my first bill as they did not resemble any on the leaflet regardless of area on the leaflet. He asked me what the leaflet said and after I told him the tarrifs for E7 East Midlands he conceded that the tariffs on my first bill were in fact incorrect and promised me to send me a new bill, this will shave off £35.01 off the quarterly bill.
My question is would I have a case for claiming back the difference (£41 by my reckoning) between standard meter tariff which I wanted and the default E7 east midlands tariff I am being charged on this new bill?
I cannot see why they would have to change the meter as surely they would only have to add the two meter readings Kwh together on the E7 meter?
