I would have thought quite the opposite.
My caseworker was over-zealous to the point of defrauding me of money by using falsified evidence about my circumstances. I even had enough evidence to get the caseworker in an interview with the evidence being placed on a table.0 -

That might jeopardise my claim because I want to keep the criminal law route open for the time being.
There is every possibility the CSA will continue refusing to cooperate and I still hold enough evidence to re-start the investigation.0 -
On page 28 of the consultation document (downloadable from the DWP website Redsky posted a link to earlier) are some questions which I guess they want you to answer in feedback. I don't think they are very good though as they don't cover much! They are more about the processes around getting parents to talk to each other and integrating support for making private arrangements. I intend on just giving a written response and maybe even copying in my MP!
It's not that I'm against the proposals completely, and I can see an argument for charging. However, I feel strongly that PWC should not incur charges as a result of the NRPs failure to cooperate. I think that if the NRP fails to cooperate and the PWC has made every effort to cooperate, the charges should fall on the NRP. If the PWC doesn't want to try and work things out, then fine, charge them.
I also think that if the NRP cooperates with the calculation, but then fails to make payments, the NRP should be charged for not keeping up the agreement, but don't see why the PWC should be penalised financially by having a % of their maintenance deducted. It will not be their fault if the NRP fails to make payments to them, so I don't see why they should suffer. If the PWC chooses to have the payments made via CSA because they simply don't want them direct, then fine, make a charge for the service.
I know the point of the proposals is to promote parental responsibility on both parties, but in a lot of cases the reason the CSA is involved in the first place is because that has already broken down. In those cases where the CSA were involved for greed or malice, then perhaps the introduction of fees will help ease a lot of the pain NRPs feel who were always good at supporting their children before the CSA was imposed on them (like my husband)
I also think £100 application fee is very high, even for some people in work. I work but am on a low income. £100 would be a lot of money for me to find to simply apply for what I am actually legally entitled to.
