Help! Creditor would rather harrass than let me pay

I want to finish repaying my loan by making a final payment of £ 4,000. But my creditor is a private individual who wants me to pay the money in pesos currency to a bank account she holds in Asia. (We are both from Asia). She informed me that she has closed her London bank account, therefore I cannot pay into that any more. She does not want me to pay her in £ even if the amount was loaned in £.
She has already denied receiving 8 previous payments that I have made. Closing her bank account seems to me to be her latest ploy to deny that I have ever paid back any money.

In desperate times I thought it would be alright to take a loan from her because she presented herself as a sort of philanthropist who was dedicated to helping people in need. She seemed a really nice lady, helped me to get odd jobs when I couldn't find a job, and was extremely helpful in general. Even though a lot of people in our community were saying negative things about her, I chose to take her side of the story and trust her. After the loan she proceeded to send people, personal guests of hers (or her goons?) to come live with me in my rented room. She flooded my days, months, weeks with personal requests and emergencies. She tried to make me collect money from her other debtors, etc. When I said I wasn't going to do those things anymore, she started telling everyone I know that I was a thief. She humiliated me in public, harrassed even my housemates. The more I paid, the more she complained that I never paid, that I had tricked her when she had been nothing but a saint to me.

Now, all I want is to finish the loan at least. She can continue harrassing me for no reason if she wants to. But i just want to sort out the loan.

I'm hoping for advice about alternative ways to send/pay money to someone...if they have closed their account. Or can I send the money anyway - to her just-closed account? Would her bank forward it to her somehow?

Or can I start a London bank account in her name and put the money in there, and let her know it's all there for her? I know this mess won't end here, but I want to be able to say at least that I have paid in full.

Is there anyone to act as a go-between? You say that you are part of a community and I will assume you are both known in this community. Is there someone you can trust who could therefore speak with this lady and give her the money on your behalf so you dont have to deal with her further. Any payment should be made through the official channels i.e. cheque or bank transfer so that there is a clear paper/electronic trail so she cant say it was never paid.
  • Why not just pay the money into her Asian account, get a signed receipt form the bank/company you use to do the transfer and be done with it?
  • 1. I am wary about paying into her Asian account because she also wants my money to come from an Asian account, not a UK account. It gives me the impression that she is preparing to claim in a UK court that I haven't paid.
    2. Her calculations converting into Asian currency using various Forex rates and applying various interest rates are complicated and also, unclear. She also makes separate partial calculations that I dont understand. The result is an overblown amount of money - using a direct conversion back to UK currency, it is as though I owe twice the original amount.
    3. I thought about paying her from my London acct to her Asian account, but the overblown amount, plus the uncertaintly factor - what is she going to claim that this fund transfer was about? makes me think that is really not an option.

No one wants to act as a go-between because she is supposed to be trouble, and a bad character people say. I heard these things only long after I met her. In person, she's the most cheerful, sunshiney person in the world. Much later I learn that she is considered as something similar to a "loan shark".

I have paid money into accounts that weren't in her name, via a go between whom I thought I could trust - just because the constant calling, insulting, shouting, and emailing and accusations got unbearable at that point. But now the go-between is also denying those payments.

I feel I have enough proof actually to sue them for harassment, fraud? entrapment? - because she has denied one payment in her recent personal letters, which she had accepted as a payment from me in a much earlier letter. Also, for the 7 other payments she denies in writing, I have the original bank slips.
Only I do not want to sue and make things complicated. I just want a way to pay into her account.

My only other option may be to use an agency that deals with loan and loan advice, as a go between? Could anyone suggest an agency that could do this?

I know it is a very stupid problem I have got myself into but I would really appreciate some advice
  • If this is not a wind up then OP is in serious trouble!!
Paying money into 3rd parties accounts indeed tut tut.

If this lady is already denying 8 payments from you, I can't imagine paying the loan off is going to change anything. You need professional advice, not an internet forum - go and find a lawyer straight away.

Agreed - there is clearly nothing you can realistically do if she is already denying payments made. Get a lawyer asap.
  • I would like to pay the money asap then get a lawyer, so that I can more easily prove that her accusations are totally baseless.

However if there really is no other way to send money in to some account in her name, then you are right, a lawyer would be my only option.

Just ignore her and hope she goes away. And when she comes for the money, tell her to get stuffed.

She has denied 8 payments. What makes you think this one will be different? What happened to the money from those payments? Has it been returned to your bank account? If not, surely it's the police you want. What can possibly be a legitimate reason for her needing the money paid into a foreign bank account?

If you have the proof of the 8 payments I hope you are deducting them off the final balance and photocopying bank receipts to send to her. Do not pay her twice, Try to get everything she requests in writing. Good luck
