    Thanks so much for all your useful responses. the action I propose to take is the following:

    1)Phone NHS manager and explain that I parked in a disabled space after taking advice from an NHS member of staff. Paying for parking didnt seem obvious and in any case, it would not have been feasible as it would have delayed treatment in an emergency situation.

    2) Phone cowboy company
    and tell the situation without revealing the identity of the driver, or giving unnecessary legitimacy to their "fine".

    3) Put this in writing to NHS manager.

    4) Send a cheque for £5 to cover "losses incurred" by non payment to cowboy company and tell them that this marks the end of the dispute.

    Any other advice?


    Do not even think about doing 2 and 4. Dangerous plan with NHS tickets, do not do this!

    Contacting a PPC is an absolute no-no, they will record the call and you may inadvertently say who was driving. If the NHS Trust decide to take things further it could make life difficult for your friend! Also their phone numbers are premium rates. And this is a scam so why on earth are you biting?

    And offering an amount is an absolute no-no as well. You have not read enough about these cases. It could be argued that making any payment is admitting liability, this has been discussed on another thread just a month or two ago. No-one here thought it was advisable at all!

    Do what I advised you to do in my previous post. Simply put in writing the verbal contract and that's that, stating the position without naming the driver. You don't even need a reply. Phoning might be useful first if only to establish who to write to (and don't just be fobbed off with 'all correspondence has to go to our parking company...'. Errrr...no it doesn't). :p

    Either that or ignore them completely and chances are nothing will happen anyway except letters.

    Right, I see what you are saying. I will not make any contact with the PPC. The only final query I have is that are you aware, as I stated in the OP that I did not in fact have a valid ticket.

    I know these companies have no legitimate legal power, but despite the fact that I parked in a disabled bay (under advice from receptionist), we still hadn't made payment because we were more concerned about getting me treatment. As well, we didnt know it was a pay and display car park.

    I just wanted to make sure that you were aware of these facts.

    I have just phoned the hospital and spoken to the estates department where the member of staff said "We cannot talk about these things, you need to talk to the PPC". I got her name. I will now send a letter to Birmingham and Sandwell NHS trust as you have advised and we will take it from there.

    One key point you attended "Accident and Emergency" for treatment. If you feel you must write to the hospital executive explain the situation and await his/her reply. [No reg number and no driver details] If they answer you in the positive ie; the charge will be dropped. Send a copy to the PPC if a follow up letter arrives. If it in the negative sorry you have to pay then ignore them both.

    2 & 4 will only encourage the PPC.

    I know we have said some NHS have tried to enforce it is very, very rare! If it did get that far I believe a DJ would see an Accident as a more pressing matter then a parking issue!
