Play.com and Hermes delivery

I ordered a USB 500 GB hard drive from Play and this morning found the parcel dropped over my 8 ft back garden wall by Hermes delivery. I don't even know if I should bother opening the package. Of all the parcels to drop it had to be a hard drive. I could open it and try it but what if something goes wrong later down the line ?
Am I within my rights to refuse it on grounds of the way it was delivered..er I mean dropped ? I once used Hermes to send some VHS boxed set to an Ebay buyer and they received them with the boxes smashed.

You could reject it under the distance selling regulations (notify the seller of this within 7 days of receiving it) and they then have to organise carriage back and a refund. Then buy another.0

Surely anyone with half a brain will know you don't drop a parcel 8ft onto concrete. Why would a professional courier service do that ?0

I have heard nothing back from Hermes after complaining.
Also, it cost me over £4 to send the item back to Play.com.
All this inconvenience because a courier decided to drop the parcel over a wall.0 -

You probably wont here from Hermes - they have got paid regardless but maybe if you mention it to play then they will take it up with them as they are Hermes' customer not you."If you no longer go for a gap, you are no longer a racing driver" - Ayrton Senna0
