My current company have now appointed an agency to take care of the PR department. I have been told that the agency will be offering me a TUPE option. If I refuse will I been entiled to redundancy seeing as my role will not be the same and therefore the terms and conditions will differ?
I would appreciate any help.
Many thanks. Gal

I would be very careful about refusing a TUPE transfer, and I dont think you have a right to redundancy.
TUPE does protect your T's & C's so if your role does change,as in my experience of a TUPE transfer,it will, your Terms will remain the same.
How many people are affected and is there a trade union involved ?Space available for rent0 -
If your role is transferring it should be protected under TUPE on the current terms and conditions. You should be consulted over the transfer so aware of any proposed changes.
They can make your post redundant after the transfer taking the total of the new organisation into account. Again they would have to follow the normal redundancy procedures.0
