Problems with Moorcroft Limited acting on behalf of Virgin Media

Hi everyone, I'm relatively newto this forum so please bear with me.


I have been receiving a high number of letters from Moorcroft Ltd regarding an apparent debt from Virgin Media.

I took out TV and Broadband from virgin in May 2010, there was a problem setting up the direct debit to my bank account and therefore have never received a payment from me. When i originally phoned them up to discuss why the direct debit hadn't been set up, all i got was aload of crap from their representative.

At the time admittedly i was going through some financial difficulties, of course i tried explaining this to them but obviously they didn't listen. Anyway, the account was then passed to Moorcroft Limited (Virgin media are still charging me £42 a month despite the fact i am not using their services, maybe a bit of advice on this?) who have constantly sent letters claiming they will proceed with litigation if the full amount is not received within 7 days, the usual stuff from DCA's.

Firstly, one of the letters has "Pre-court devision", am I right in saying that Moorcroft are in no way associated with any courts, and are therefore breaking the law by having this as their header?

Secondly, I never signed ANY contract with Virgin Media, and have never made a payment to them... Does this mean I am still liable for the amount that they are saying I owe them? (£392.41)

Lastly, Moorcroft have stated that all fees included in this "litigation process" will be passed on to me (solicitor fees, admin fees etc) I dont have a contractual obligation, so is it actually possible they can do this?

I welcome ANY piece of advice anyone can give me.

  • Im no expert but i would just like to say that my OH has had many of these letters off moorcroft yet they have never been acted upon.

    all perfectly legal, by accessing their service and having it installed you agreed to it. Dont be suprised if virgin dont take you to court and they can add costs and intrest. Remember they have a recorded call or internet order entering into a 12 month contract
  • Interesting. I am in a similar boat with Virgin media and Moorcroft, although in my case Virgin media never supplied me with a service - they were unable to for technical reasons, and were unable to locate my account when I made previous complaints.

    I have written to Virgin Media, but judging from other customers comments elsewhere on the internet Virgin have been registering defaults on people's credit histories even if the bill is paid by the customer or cancelled by Virgin themselves.

    I have a funny feeling I may need to take preemptive action on this, but I will wait until I receive Virgin's response to my complaint. I would prefer them to take me to court as this would be the quickest way to resolve it, but because the debts get sold on through chains of these agencies that is very unlikely to happen.

    All I can say is that I would never deal with Virgin Media again and I would not advise anyone else to do so.

    They can't charge you for the service anymore if you cancel it.

    The difficulty, as I see it, is even if I see off the current debt collection agency they will just sell the debt on to another one. I am tackling Virgin Media directly, but I suspect their ability to cancel the debt is limited now they have sold it on.

    Its interesting that they have sold it on so quickly.

    I am considering a number of options, but given the ability to sell these accounts on I don't want to waste my time getting the current one to leave me alone as it will just start up again.

    There really needs to be some legal framework for challenging these things akin to a small claims court where the other party would have to defend an action by presenting evidence. If they didn't then the whole alleged debt would be cancelled and couldn't be sold on again. Perhaps in a parallel universe!
