    It's quite the norm to go to the third party insurer when the third party is liable.

    Ty. Is there any claim handlers you recommend for this. The only ones I can seem to find handle just personal injury claims.

    Your local bodyshop will be able to recommend one.

    Or use your own solicitor (the third party will pay his costs, assuming they are liable)

    So when I rang up to make the claim Swift cover asked my occupation. I didn't know what to say but told them at the moment my biggest source of income was coming from poker.

    Firstly I had no idea that Swift cover didnt insure (as they quote in their T+Cs no Full or part time gamblers) . I wouldnt have used them in the first place had I known this. This is my 2nd year with Swift cover an I even had a claim go thorough fine last year and nothing has changed since last year with regards to my occupation status.

    What did you tell Swift cover your occupation was when you first took out the policy?

    If you said you made money from poker, and they gave you a policy, I don't see how they can cancel your policy now!

    Legal Cover often does not cover claims/action against the insurer.

    Situation seems clear regards your own damage - claim direct from the third party. Gp direct to their insurer - the third party should have provided or will provide their details. The insurer will set you up with a hire car and sort out your repairs for you.

    You should know that the repairer or solicitor will probably get a refferal fee from the accident management company they direct you to. You can find some via google - accident management company, credit hire. Some names in the market include Accident Exchange, Drive Assist, Enterprise Rent-A-Car, Car Crash Line.... Not that I am reccomending any of them, they charge huge rates for car hire to insurers and therefore push the cost of claims and so premiums up.

    Regards your issues with swift. These are far more serious. Essentialy you have failed to disclose a material fact to them - that of your true main or even part time occupation. This is a serious offence, if deliberate is is an act of Fraud. Sadly many people do this daily - simply lie to get their insurance much cheaper, don't pay the correct rate and so push rates up for those of us who tell the truth. Insurers and large brokers are cracking down and getting better at spotting this, however.

    Reading your posts and taking them at face value, this looks like it is innocent missrepresentation. The situation will end the same whether innocent or not, swift won't cover you as your occupation is outside their acceptance criteria. The think you need to do is prove that it was innocent, so reducing the long term issues for you. (If innocent, essentialy this should be like you calling to tell them your occupation has changed to gambling, and they saying, sorry, can't insure you any more - you then go elsewhere for insurance and don't have to tell the new insurers you have had a policy cancelled by an insurer.)

    Did you tell them at the time what your occupation was - i.e. told them your main income was now from gambling? If so, and they did nothing, this is excellent for you as you can argue that you were innocent as you told them about it and they did nothing, so how were you meant to know they were interested? (I am paraphrasing).

    What did you tell them your occupation was when you took out the policy origionaly and what was your main occupation at that time? If it was gambling then and you didn't tell them, then you don't have a leg to stand on - you have missrepresented a significant material fact when answering a direct question when you took out the insurance. They are asking for information about your income history to investigate this probably - and this is perfectly reasonable, you have to prove your innocence.

    The key thing is not to get angry with them and remain calm and pleasant on the phone, people are just doing their jobs and you want them on side.

    Finaly - is your car insured at the moment? Obviously, don't drive it if not, as you will find yourself in trouble with plod too.
  • Isn't computer repair your work and poker your hobby though? Surely it doesn't matter which is producing the higher income. If computer repair is what you do, then that is your career.
  • Meant to say, I know a taxi driver who earns more on computer poker... dare I say at the moment, but his career is a taxi driver.
