Wrong version of wii game bought

HI - can anybody help - i have accidently bought a NTSC version of a wii game instead of a PAL via CD WOW. I was unaware that these games were zoned but they have basically said I should have read the smallprint! What are my rights - if any? I have just asked for an exchange but they said no - it is Lego StarWars The Complete Saga Wii. It is all very distressing since I am fighting breast cancer for the 2nd time and my Father has been diagnosed with terminal cancer and heart failure hence, I ordered in haste without really looking at small print since I had other things on my mind. Have been a customer for years but that makes no difference. Do I have any rights at all or is this a lesson learnt expensively?!:(

    You should be able to notify them of your intent to return within 7 working days of receipt under the Distance Selling Regulations. This is a legal right you have if bought from the UK (and they seem to be a UK-based company, I may well be wrong though)

    Sorry, but that comment is totally out of order - nowhere does it state that the game is actually for the OP (Could be a gift for example), and even then, we are all prone to mistakes once in a while. ( I certainly wasn't aware that Wii games came in different formats and wouldn't therefore be consciously checking for whether it was PAL or NTSC - although I will be from now on )

    OP - as stated above - have you actually received the game yet? and if so, have you actually opened the packaging? ( I think the DSR does not cover software that has been opened/unsealed unless faulty? )

    Not sure - the post mark on the envelope is the 18th December from the USA so with weather etc I suspect it was beginning of last week? However, have opened item so guess that could be held against me as well?

    The game was a present for my nephew so not even opened when given, my brother bought it back to me yesterday having tried to play on his sons new wii bought at christmas and being unable to. I then tried it on mine with same thing happening. I really do have a lot more on my mind then looking at different regions etc when I didn't even know they existed. I bought from a UK on line company and stupidly assumed they would be selling UK games, I also bought very quickly on this assumption. I think your response is a little unfair.

    There's probably very little you can do except appeal to their generosity. It is mentioned on their website that they sell games in different formats.

    Could you sell it on ebay?

  • Lori007 you really have my sympathy, as I recently had to deal with 'life's little problems' on top of coping with a critically ill parent and it isn't easy or funny. :wall:

    Unfortunately opening this probably voids most of your distance selling rights, so unless CD-WOW are willing to be co-operative to retain your custom then your best bet would be to sell the game on via something like Amazon Marketplace (which I use a lot myself) or eBay (which I haven't sold through) and let CD-WOW know they have lost your custom for good! CD-WOW are not UK based but are somewhere in the east, probably China, as far as I recall. I used to be a regular customer until a couple of years ago when they changed their payments methods and purchase terms and it seemed to me, on reading the small print, that if they made an error, I would have to pay the return postage costs (to whichever country it was sent from). NOT acceptable!

    There are plenty of more reliable UK sites to buy from, and I recommend using pricedemon to check prices first, so you can get what you're looking for at the best possible price.

    Finally, one other option may be to see if you can remove the region code from the Wii, to allow you to play the game you've got. You can find plenty of info on how to do this online, but I'm not sure whether doing so would affect your Wii warranty (if it's still under warranty) or whether firmware updates would cause a conflict. It all depends on how expensive the game was and whether you're happy altering the Wii configuration.
