Hi guys
My situation at the moment is I was made redundant at Christmas, nice pressy huh, but I haven't got my redundancy pay yet, at the moment I am on garden leave for 10 weeks, which is my notice period, so I am literally sitting at home more or less, I won't get my whole redundancy package till the end of this month, that will be Statutory Pay, 10 weeks pay and holiday pay.
Now how does this redundancy thing work, if I start a job before the end of this month, will I be still entitled to my whole redundancy package or can they revoke it?:(

You are on gardening leave thus you are still employed and whilst free to seek another job do not start before the redundancy date. Gardening leave means all your contractual elements remain active and you could be asked to perform your role or attend.0

:mad:This seems to make sense to me, but the HR Manager at my place of work is saying different, her input is I was made redundant in December so I no longer work there, as in my redundancy package I get the whole of my 10 weeks notice they are calling it 'payment in Leiu' as don't think they will be calling me in to work or anything, as this came about due to cutbacks, so I am free to start other employment, I don't know what to believe as I am a bit wary that starting a new job before I get my redundancy package will mean I will forfeit my redundancy?
does MSE know about this?

If they have terminated you then they should pay out in reasonable time
Next payroll run is reasonable which sound like what is happening.
What does your termination letter say is you last day of employment.
Loks to me like you probably have probably been terminated so can get another job, as long as the payment terms are in riting htat maches up with the termination date0 -
I agree with getmore4less. If they HR have said your employment has terminated then you should receive all your payments for notice, holiday and redundancy. If you are "on garden leave" then you continue to accrue your benefits including holiday and any additional redundancy payment if it takes you into another completed year's service.
If they have not paid you, and you think you have an opportunity for a new job you could write and confirm the statement from the HR saying your employment terminated in December and that you would like confirmation of when the payment is being made as you are no longer an employee of the Company.0
