Insurance Company wont pay my claim

I recently had a crash which didnt involve anyone else, i crashed into a lampost after losing control of my car.
The car was written off, but my insurers wont pay out as they say i didnt inform them of 3 points i recieved back in August 2009.
However i rang one of their operators to report the 3 point penalty, and was advised to put it in writting as the computer systems were down.
I did this and have a copy of the letter with all my other insurance paperwork going back 5 years ( sad i know but justified now).
The funny is i have always informed them of any points i have got in the past (6 in the past five years) and did the same with these other 3 points.
I have been driving for 21 years, never claimed for a crash before. And i was preparing myself for an increase in my premiums, but this is another way of the insurers getting out of paying.
Does anyone have any advice on where i can go with this, in order for them to pay for my claim?

  • Well of course your Renewal after August 09 will show these points and you will be fine???

    However as long as it was inadvertent/innocent non disclosure; Your insurer cannot refuse to payout unless they can show had they been aware they would have refused to insure you. For 3 points this is unlikely. Instead they should payout but deduct the added premiums you would have incurred had they been aware.

    I suggest you go online and get proof of a quote with 3 points to show they would have insured you and then compile an appeal. Read on the FOS for more information on these guidelines.

    Its quite old but mostly still relevant.

    Therefore at worst you would face a reduced payout.
