Tribunal hearing

well,
Yesterday we had our tribunal hearing that got cancelled due to snow prior to Christmas.
for all the worrying, I have to say it wasnt as daunting as we thought it was going to be and all 3 members of the panel were very pleasant
We got the letter this morning to say that we have been awarded.
High rate care for our DD
And they also recommended we submit paperwork as they feel we should be entitled to low rate mobility also for her.
So at last some good news that will help ease the financial strain of many hospital trips around the country with her to see various specialists
My only other question now is, does the award of high rate care entitle us to any other benefits. A friend has bentioned we should be able to claim carers allowance now...isnt that the same thing as high rate care dla?
Grateful of any pointers people can provide

Eh ??
I was on DLA when my wife claimed carers allowance for me and we lost nothing.
I dont think Carers allowance is related to DLAThe DWP = Legally kicking the Disabled when they are down.0 -
The main Carer can claim Carers allowance if they care for at least 35 hours a week. If they earn over £105 per week I don't think they are eligible.
Also if you get Child tax credits, there is an extra severedisability premium,so you should notify Child tax credits.xx0 -

I think you mean the SDP? severe disability premium?
Which is only payable if you live alone or with other adults that also get MRC/HRC and if no one claims carers allowance for you, the SDP is only given if you claim means tested benefits and most likely IS.
Your DLA care and mobility are not affected by any other benefit except when it makes you eligable for higher benefit like CTCs.0 -
Am i correct to assume that CAB would direct us on what and how to claim anything over and above the HRC we have been awarded0

Hello,
Glad to hear your Tribunal was not as bad as you thought it would be. I had mine yesterday and it was a completely different and more understanding/compassionate experience than the Atos medical.
All the best to you.0 -
hi all,
I hope I can find someone here who can help and advise me....
I have applied for DLA in May 2010. I got the decision in October and as you can guess, they turned me down for both components.
I got a diagnosis of major depression with pschosis and I use 3 medicines for that..In addtion I have been diagnosed with type 1 diabetes and high blood pressure.(all were diagnosed before the decision)
On the other hand, I have canal stenosis on my lower back for 5 years which was worsened after a bus accident last year and I cannot currently walk without a crutch and cant leave my home if there is no one with me.
I coudnt be able to work since july 2010, mainly due to my mental health and due to trying to kill myself. and receiving ESA with support group without a medical.
I asked for reconsideration for my dla, wrote a letter to them explaining how my conditions affect me, side effects of 8 medicines I use everyday also sent in 3 reports from my psychiatrist, 2 reports from the pysiotherapist and 2 from occupational t. 1 from gp, they still refused.
I got my tribunal hearing next wednesday and I am worriying about this as I dont know what to expect apart from seeing 3 people questioning me about my conditions.
If anyone can answer, What do you think my chances are at the tribunal???
Is there a possibility that they can agree with the DLA people saying I have no care needs neither I am virtually unable to walk??
If it sounds that I am entitled to it what component do you think it should be and what rate?? and what is the likely period that they might award it for?(i am having the mental health issues for almost 2 years now)
I know some people may laugh at me for these questions or some may think how stupid i am asking these here....
But I truly need someone to reply whatever the answer is pleaseeeee0
