Interum Justitia Debt Collectors - Help

Hello.

Apologies if this is in the wrong place, but I wasn't sure whether to put this here or in the DFW forum.

I received the following letter from Interum Justitia Debt Collectors:

NOTICE OF INTENDED LEGAL ACTION
OUTSTANDING BALANCE: £76.05
CREDITOR: eBay .International AG CREDITOR'S REFERENCE: 107338510 OUR REFERENCE: 145679952N/81
Instructions are being prepared for the issue of Court Action against you, which may result in the entry of a Judgment. This may substantially increase your liability and your name and address may be entered on a Register of Judgments and the records of the credit reference agencies.

Failure to make payment after the Judgment may result in the use of a Bailiff or Sheriff Officer, or deductions being made from your wages.
It is essential that you make payment immediately using the giro slip attached or by telephoning us on the above number as we may be able to take your payment by debit or credit card.

Needless to say, this has just added to a boat load of stress that I've been under recently. Immediately after receiving this letter, I logged onto the eBay site, and found that my account is overdue by £60.05 (£16.00 less than claimed in the letter). My account has been suspended, meaning that the only activities I can perform are to make payments to eBay. I wrote to their ukreception@ebay.com address (quoted when you call their telephone helpline) stating that I had received a letter saying my account was overdue, and that I would pay £26.15 of it, but that I was disputing the remainder due to non-paying bidders. I have the evidence to prove this. I know that I should have sorted this out within the 16 day time limit (the NPB occurred in July) but I would have thought that any reasonable company would accept that I am sorting this out now and agree that my reasons for the dispute are valid. Anyway, I made the payment of £26.15, but have since heard nothing from eBay (I wrote to them last Saturday (28 October).

I'm not sure what to do now and would really appreciate some advice. I've heard and read all over the place that one should never deal with Debt Collectors, but always with the company concerned. I've also heard a lot of really scary stories about people randomly turning up at your house being threatening and intimidating and as good as forcing you to pay there and then.

I am more than willing to pay what I think is fair, and as stated above I do have proof to show that the £33.00 charges that I am disputing should be waived in all reasonability. But what do I do seeing as eBay are not responding? and wht time frame do I have before I really need to start looking over my shoulder and staying up all night?

Sorry if this seems a bit rambly, but this is literally pushing me over the edge of what has been a very stressful couple of months.

  • contact intrum justicia to inform them of your ongoing dispute with ebay. provide a record of your receipt for payment sent and keep the originals. send it all by recorded or special delivery. keep copies of correspondence for court if it gets there.

    Thanks. I will do this right this morning. How likely do you think it is that things will escalate, or would they refer the matter back to ebay?

    Ebay have strict time frames so are unlikely to write off debts as it sets a precedent. If you are disputing final value fees due to non paying bidders then you really needed to have done that in the time frame allowed for by ebay. There is a system for reclaiming final value fees, which if I read your post correctly you did not go through. Unfortunately no one can just pick and choose which fees they pay to any company, if they are now payable as you did not ask for them to be repaid in the time frame allowed, then I would think they remain payable. You say that any reasonable company would see these debts are not payable..yes ebay would but *you* choose not to claim the refund.

    You might persuade ebay to merely accept the total fees outstanding now to call off the debt collectors, (ie remove the additional amount incurred by debt referral) but I doubt very much they will write off the full amount.
