Please Help- IVA Creditor Meeting Arranged but Court Summons received for Council Tax

Hi All,

We have today received a court summons (letter - not blue claim forms) for the council tax arrears for this year (01.04.2010 - 31.03.2011 - currently standing at £804.00 with Summons Costs)

I am both concerned and confused as to why we have had this as Grant Thornton said all our Creditors have now received their proposals so why will they have sent us this?

They were included in the Proposal but the letter is dated for the 10th January.

The summons is for the 1st Feb at 1.45pm - the Creditors Meeting is on 20th January at 3.30pm so obviously the Creditors Meeting will have taken place by then.

I have rang the Council before when we have had one of these (it has happened once a couple of years ago) and we came to a payment arrangement - this is also detailed as a possibility on the back of the letter.

However - what do I do with the IVA and Creditors meeting in mind?

I don't want to commit to the monthly payment of council tax plus arrears payments as this is going to severely affect the income and expenditure and also they are meant o be included in the IVA.

I am really worried about this as it threatens Bailiffs, Charging Orders and Bankruptcy.

I know that once the IVA is in place we would need to ensure Council Tax payments are met - which we will be able to do, but this latest development threatens to throw a huge spanner in the works I think?

    Bailiffs, Charging Orders and Bankruptcy aren't going to happen before the creditors meeting, so don't panic there.

    I suggest you have a word with your IP and see what they say. This is quite likely to be a case of " the right hand not knowing what the left hand is doing" (which happens with many creditors).

    Hi, thanks for your response. I certainly hope that this is the case but I am worried this is them having their last ditch attempt. This sucks and I'll be so happy when the meeting has gone ahead and everything is sorted and in place.

    I have emailed our IP (they were shut by the time I got in from work) and asked for an urgent response, so hopefully I'll hear fairly swiftly tomorrow - it's Grant Thornton and my contact there is usually pretty prompt in her replies.

    It's all such a worry though and I'm so stressed by it all. This has ust made me even more worried.
