Notice of Intended Prosecution for speeding

  • You can usually request the photos and the police will invite you down the local station where they will show you the pictures on their computer. I know as ive done it myself. It also doesnt matter if you were driving the car or not, you have a choice - say you dont know who was driving at which point the police will prosecute you anyway as its your car and its your responsibility to ensure you know who was driving - so you will get a court apperance - 3 points (possibly more) and a fine plus costs, or you plead guilty to speeding and take the 3 points and £60 fine. Simple as that. I know, ive been there and done it!
  • and was doing 33 and still decelerating when the camera flashed and apparently recorded me doing 46, I was a bit gutted though!
How do you know you were doing exactly 33? That's a pretty precise figure.

Best to say 30 to 35

That way it doesn't look as if you drive with your eyes on the speedo and not on the road

Well they clearly weren't on the road if they were able to discern the readout on the speedo with such accuracy. Particularly when you factor in how quickly the speed will drop when you're braking.

Fail to name the driver and the OP could be looking at 6 points and a fine of about £500, however he hasn't had any paperwork or so he says. I do wonder how the wife got named though.
  • Hadn't intended to hijack the thread, should have been more succinct to avoid attracting irrelevant comments, sorry. Bowing out now.

But that's what they want us all to do isn't it? After all speed kills and so long as you stick at or below the number at the side of the road you will be 100% safe and never have an accident.

If you say so, but it will only work if we all do it.:rotfl:

Our car was clocked doing 40mph in a 30mph area on Nov 26th 2010. We received the NIP today, with the post date of 11th Jan 2011. That of course is way beyond the statutory 14 days but there is an issue that may affect us still.

1 - Due to mistake at the DLVA we've found out that another vehicle has the same reg number and therefore the DLVA do not know the registered keeper. We obviously have to correct this anomaly at some point soon.

2 - I am the registered keeper according to the registration document (received after buying the car some two years ago). However the NIP was addressed to my wife, presumably because the authorities checked against insurance records as it is insured in her name.

3 - The NIP says there is photographic evidence even though there is no camera on the stretch of road in question. Therefore it must have been a mobile camera and most likely front-facing.

4 - As it was some time ago neither my wife or I can genuinely remember who used it that day (we tend to share it frequently).

I'm aware that exceptions can be made for prosecution where the authorities could not reasonably track down the keeper within the statutory period

In short, should we ask for a photo to determine who drove the care that during the 28 day period we have to respond?

Also, does anyone think this is a case worth defending?

Many thanks in advance for any helpful replies.

I'll take your post at face value. I'll assume that you meant to write that a car with your registration mark was clocked at 40, given what you have written about a DVLA mistake.

I would suggest that you complete the NIP as the registered keeper of the vehicle but do not complete the section that asks you to name the driver. Make sure that you sign it. Include a letter stating that you cannot be sure if it it was your vehicle at all in light of the DVLA mistake but that you would be willing to review the photographic evidence, and if it is your vehicle and you can identify the driver that you will do so. It might also be worth stating that if it is your vehicle that it could only have been you or your wife that was driving.

I suspect that the force would send you a copy of the photograph and a second NIP. At this point, if it is your vehicle, you will have to tell them who was driving. Do not contemplate a husband/wife defence if you can identify the driver from the photograph.

    Hope that helps.

No one is claiming that by sticking to the speed limit you will be 100% safe and never have an accident, but speed has been proven to be an important factor in both the incidence and severity of crashes.
