    thankyou, The deeds are still in the bank so I shall have to check them. As for the tenancy, I shall have to take this up with the dwp, I'm unshure.

    thankyou, my name was on the morgage from the offset as my parents were unable to get that amount of uninsured credit because of their age. When my father passed away I was still working, only very recently had to claim HB but during the interview in the jobcentre I was asked if I was a houseowner to which I replied, part owner. My name was on the morgage for the family home but it's been paid. They asked me if I was charging or receiving rent for the property, to which I answered no. When I explained that I own
    a third, my mam owns two thirds but is still living there they said it wasn't a problem.

    While the deeds may be the only copy, why dont the imediate family who are most likely the executors of the will all have copies of the will?

    I have copies of my closest families wills as they do of mine, wills are important legal documents which need to be produced upon the death of the author to make sure that their wishes are taken care of but in relation to your mothers will it is void in relation to the home where you were also on the morgage if you were joint tenants, in that case you own the property and your brothers dont own a brick.

    I noticed this, my mum had half a property with dad (but they had split up), she did not live there but myself, hubby and children did and we paid her mortgage for her - she did not get any rent as such from us. But when her partner lost his job (and he was in a council house) HE was not entitled to HB as mum was living with him and had an interest in the property. I would double check with someone to be on the safe side if I was you.

    I would also thank god that my parents invested in something that meant I was able to get out of a hole in this particular time of your life when you needed the money the most, not complain that now you have too much money and that you might not be entitled to benefits anymore. I do not see you so much as a 'victom of bad luck' but more that this has come at the time you needed it most so you do not have to rely on the state. If you are going to mention about having paid for xx number of years you have worked and paid taxes etc... what do you think is funding your DLA and your NHS healthcare, operations, doctors, etc... It is all swings and roundabouts at the end of the day.
