SSP1 and a stubborn employer

Hi
I was wondering if any one could help me with this.
I have applied for ESA and they have told me that i need an SSP1 form from my previous employer, however the employer says that they don't give SSP1 forms to people who are not currently employed by the company, the Job Center has even contacted them with no luck.
Can my ESA claim be processed without it? And is there anything I can do about the employer, do I have a legal right to it?

Were you still Employed at the time you went Sick? You can download the form from the internet if you need it http://www.dwp.gov.uk/advisers/claimforms/ssp1_print.pdf0

Were you off sick on the last day of your contract of employment? If you were then you need an SSP1. If you were in work and only saying that you were sick from the day after you were last employed then you dont need one.0
