Paypal/Zavvi Ebay Outlet/DPD dispute

At the end of November I ordered an item from the ebay seller zavvi_outlet. Whilst on an overseas trip I received an email from DPD regarding an attempted delivery. I used their website to request that the item be redelivered the following week when I would be at home. A couple of days later I received an email from a customer service advisor apologising for the delayed response and informing me that the parcel had been delivered and signed for the day after the first attempted delivery.

I replied (and have kept all the correspondence) to this email pointing out that I have not and could not have signed for this package. Upon my return there was no package and neither had any of neighbours accepted or signed for a package from DPD.

I contacted DPD and spoke to the same advisor who apologised but informed me that a DPD investigation could only be instigated by the sender of the package zavvi outlet.

I contacted zavvi outlet but having received no reply after a week I started a paypal dispute. After two weeks I received an email from zavvi in response to the dispute saying they were looking into the claim. On the 27th of December I had to escalate the dispute to a claim before it expired. 2 days ago I received an email from Paypal asking me to either close the claim or provide documentation. I provided details of my flights and accomodation. Today I received an email from Paypal:
In response to your claim, the seller has provided proof of postage
indicating that the item was posted to you. Because the seller was able to
provide proof of postage, we cannot reverse this transaction or issue a
refund. We encourage you to continue to work directly with the seller to
amicably resolve this matter.

Where do I go from here?

Proof of postage is not proof of delivery. I would go back to paypal and strongly tell them this.
  • I will do that, but the parcel has been signed for.

    Edit:
    In my name!

Well thats the problem, theres proof of postage and proof of delivery.
  • The requirement for Paypal is an online tracking number.
The seller would have provided this to paypal.

The purpose for online tracking, is that you can see the signature of the person accepting the package.
Use the tracking number to see who signed for your package.

    Hopefully you'll locate your item,
    Regards

  • According to the tracking number I've signed for the package and there is a digital copy of a signature in my name. I haven't signed for this, no-one else lives at the address and I wasn't even in the country at the time.

You might be best off dealing direct with Zavvi, rather than trying to sort things out through an intermediary (Ebay or PayPal). You've said they emailed to say they were looking into it - email them again to ask for a status update, or write to complain that it's not arrived.
  • Is the signature remotely similar to yours? If not, and (as I suspect) the driver has signed for it, they could be guilty of postal fraud.
Can you submit a copy of your own signature to compaire with the digital one they have? You know its wasn't you, this might help them realise it too.
Please excuse my bad spelling and missing letters-I post here using either my iPhone or rathr rubbishy netbook, neither of whch have excellent keyboards! Sorry!

Did you pay using your credit card on your paypal account (not a debit card) in which case you could try contacting your credit card company and get them to issue a chargeback as you've paid for goods not received.

Have you tried phoning Zavvi outlet? They list this phone number on their auctions: 0844 243 9088

Why did you buy something you were not even going to be in the country to collect? Just curious.
