Then you're also entitled to a weeks pay in lieu of notice if they didn't pay you other than what you were owed up to that day.
Looks like you need to send a notice of intent. Basically state that there is outstanding holiday and that they broke the law by not paying you in lieu of notice and that if the outstanding amount isn't paid within XX days (say the next pay date) you will take them to Employment Tribuneral. And if they don't pay, do it. You won't be the only person they've screwed over.0 -
They are breaking the law by not giving you a contract of employment - even though you have left. In that contract there should be inflammation about holiday entitlements and notice periods.
You say that you gave the employer two weeks notice but they terminated you the next day but the amount of pay you are entitled to will depend on the notice periods in the contract - which may be one, two or even one month!!
Also, the contract of employment should stipulate the number of hours/days paid holiday you get each, whether holiday can be carried over from one year to the next and what happens to 'accrued holiday'. Others have outlined the statutory minimum and given the way your former employer operated it is unlikely that they will have specified more than statutory minimum - but you never know.
If they offered you no contract - do you know if they paid your NI and Income Tax??? Did you get a P45 when you left [it may take a couple of weeks to come through]?0 -
If you worked there more than 4 weeks, then you are entitled to notice of at least 1 week. Look on the Direcgov website for more details on how to calculate holiday pay, but if you worked irregular hours, then 12.07% of total hours is what I was advised.0
