Flat share deposit given to leaving tenant?

A friend of mine is looking at moving into a room in a shared flat - he's been told to pay the months deposit to the tenant who is leaving - not to an agent or the land lord?

To my mind this leaves him open to losing the deposit and with no legal rights to be in the flat in the first place? Or when he leaves he could lose the deposit for damage done by a previous tenant.

He's been told this is a common practise? Is this an acceptable risk? Any advice would be welcome!

When I was at uni I moved into a house share with some friends who had been there for a couple of years, and I paid the deposit to the guy who was leaving. It worked out fine (I received my deposit) but I doubt I'd do it again.

The only thing I would say about house shares is that if the people already living there have damaged the property in any way, your friend should make sure that the charges for this aren't taken out of his deposit when he or the others move out (completing his own itinerary/check list should be fine).

Have the other tenants told him to pay the deposit in this way or was it the landlord/agent?
