ESA Regulations for completing ESA50 and when evidence is to be submitted

Hello

I am totally confused.

I have two simple questions:

1. What constitutes a completed ESA50, in order to avoid having the benefit stopped.

2. What are the legal requirements that stipulate when and to whom should confirmatory evidence of non ability to work be submitted.

This has arisen because I have been told that if an ESA50 is not completed fully in every respect (all the I's dotted, the T's crossed AND further information added at the end of the form), it could be considered as a failure to submit or complete it, rendering me liable to having my claim stopped. Does a little information (just ticking the boxes only), constitute a completed form.

AND

I have the Government on one side telling me in a letter that I cannot send anything, such as evidence, to ATOS when the ESA50 is returned to them. Yet I have posters on here telling me to ignore that instruction and send it in anyhow.

Please if anyone can find me a link to the relevant Regulation I would appreciate it greatly.

I just do not want to find that down the line I am in trouble with the DWP for failing to adhere to their instructions and end up being prosecuted.

  • Since according to your own posts, you've been through the entire process of submitting ESA50s and going to appeal, you should have little to worry about regarding prosecution for non-completion of an ESA50.

    Rather you should be more concerned about wasting everyone's time by repeatedly posting under multiple aliases, eh Andy?

    I am not wasting anybody's time at all and who is Andy? I don't have any aliases. Could you please explain where you have got that idea from?

    I am only asking for confirmation as to where I would find the rules on how to complete the ESA50's. I only tick the boxes, is that enough?

    Plus so many posters have told me to ignore the statement not to send in evidence - what Regulation allows me to do that?

    I have only sent in 2 ESA50's - not mulitples - where do you get that from?

    My only worry is do I believe what I am told on here and where are the rules that confirm it. Surely that is not a lot to ask.

    If you can't help me, OK, maybe someone else can.

    Can't a guy ask questions about something that is worrying him?

    I must have wasted a lot of time for people this time, what is 114 posts and the silly idiots still keep replying. Gee, when will they ever learn that they are being had?
    I must admit that it is becoming harder to think up believable stories.

    The sad thing is Andy, you are capable of making some valid contributions, but then the same old 'me, me, me' attitude comes through. It was obvious that it was you, same old stories, but I was prepared to give you the benefit of the doubt, because it was easier than going through the whole 'Who is Andy?' scenario. But then you started taking over threads again, as you did with CHRISSYG's thread on the Disability board a few days ago.

    You are sad beyond belief, and I really do pity your family.

    Why do I bother, mainly because I have never in the whole of my career of 41 years with the service come across so many sad sad people.
    It is so easy to wind people up. Because I can, and they are so gullible.
    Hey if my life was anything like what I see on here I'd have topped myself by now!

    It breaks the time up that I spend each day dealing with and advising genuine cases that I can help.

    When I answer a request for information on this or another forum and am able to help, it makes me feel good. So if I've helped you out via one of your aliases, it's not been a waste of my time just because you didn't actually need the help.

    Granted, there is some disappointment once I realise that it was just you, but to be honest it's tempered by the fact that other people who may be in the same situation are being helped.

    So I repeat my question. What do you get out of it?
