capital one printing error

Hi all,

could anybody help me with this please?
Capital One recently (feb 09) sent me the following letter (out of the blue)

"Dear x,

Important information about your Credit Card Agreement

Please find enclosed a copy of the financial details of your Credit Card Agreement which were applicable when you opened your Capital One account. We have sent these as the original copy with your credit card contained a printing error.

Since opening your account, your Credit Card Agreement may have changed and you will have received a Notice of Variation setting out the details of the changes. If this is the case then the enclosed financial details are not your current terms.

Please accept our apologies...

Seems a little odd that it arrived out of the blue, so I'm wondering if that means that the 'printing error' (I certainly don't recall one when I signed the original form) was actually a mistake in the wording which makes it unenforceable? Has anyone else had this letter?

    On a more helpful note, you'd have to compare the terms you received with your card carrier to the ones that came with the letter to establish the nature of the printing error. If it's just a spelling mistake or something like that then your agreement won't be unenforceable; if they've advertised the wrong APR or something like that you might have more of a case. I would advise giving Cap One a call, but since the letter was sent almost 2 years ago it's unlikely that the call centre folk will still have the relevant information on file
