Last Minute.com

Hi, wondering if anyone can help. I ordered a holiday on last minute.com, I say ordered because when you "book" a holiday, on their site its an order. It's not booked until they call you back. The holiday I found was to kos, the availability for the holiday stated "on request". I looked at prices for the month of August, 3 out of the 4 weeks were priced at £800+pp but 1 week said £291pp. I checked the site this morning and the dates I booked were no longer available.
I've now had my phone call and they said that in was an error on the loading system and there is no availability for my weekend. Now on the website the holiday is for sale at £291 again.
Do they have to honour me the holiday, is this classed as misrepresentation or false advertising.
Any help would be appreciated

    In our office, we are made aware that it is illeagal to advertise a holiday for a price that you know is not valid. Availability is a different matter. If we put a price in the window it could, effectively, be incorrectly priced by the time I sit back down - basically due to the nature of the travel trade. I am allowed to continue to advertise that price in the window up until the time i either find out or made aware that the price is no longer there. This could be when a client asks me to check the availability of that particular holiday, or it could be when i check all the offers on a regular basis to see if they are still in date. If they are, i can chose to leave that offer in if i wish. If the holiday has gone, or changed in price, i must either take it out, or clearly advertise that the holiday is no longer available (putting SOLD on the windowcard is fine, and gives the impression that things are selling out - great sales tool......... lol).

    With your case, i would say that you have a good case of false advertising. Perhaps instead of 'ordering' on the website, you should call them. say you ordered that holiday the day before, but was then told it was not available, however now it is showing again and you would like to book it. If they say it has gone again, ask them to provide documentary proof that the holiday was available between the time you originally tried to book it, to the time that you noticed it on again, and see what they say.
