Thanks - yes that is the bit I found on teh DWP site and was a bit worried about, as this would seem to indicate that his benefit would be cut by about £64 a week based on his gross pension - the £850 is net - which would have quite an impact on our income, not to mention the overypayments since November.
£850 - 340 = 510/2 = 260
I can't see how he's eligible for ESA, I'm afraid.0 -
(i) As mentioned previously his pension will affect his ESA payments probably reducing them to nil.
If the DWP delay making a decision they should not ask for any monies back, however it seems to be policy that they usually ask in the first instance (protecting the public purse and all that) please seek advice to challenge this type of decision should it occur.
(ii) Have you tried to claim Disability living Allowance? This is not means tested and if he has cognitive impairment and has care and/or mobilty needs he will be entitled to claim. Sorry, but can't follow your calculations. Pension is approx £212 a week, DWP site seems to say first £85 is allowed income, therefore leaving an excess of £127 - divided by 2 this is £63.50 which would be deducted from his ESA, still leaving an entitlement of about £32???
Can anyone also explain why when he was awarded the contribution based support group ESA in July, and he was still receiving half pay from his employers (again aprox £850 a month) of which DWP were aware, this did not seem to affect his entitlement, whereas now it seems because the source of income has changed to pension it changes things ? His overall situation has not changed.0 -

Acknowledge that the concensus of opinion is that the pension will affect his ESA, but first response from Mrs. Manda indicated not - anyone able to clarify ?
What do you all think I should do now - keep phoning DWP to try to sort it out or wait for them to contact us ?
Did consider trying to apply for DLA but having got the form and having read a lot of the posts here about the hassle people have been having just about lost the will to live. Will probably contact the CAB for help with completing it.0 -
Hi I think dmg24 clarified the fact that pension income is treated differently to other income therefore the contractual sick pay that your husband received (ie his half pay) was not counted.
My mistake on stating his ESA would be reduced to nil I did not read the pension amount correctly.:doh:
You are correct the first £85 is ignored and the rest is divided by 2 and half is deducted from the total. I think you have divided his pension by 4 but if it is a monthly payment the DWP will x by 12 and divide by 52 to get the weekly amount. On £880 this would be £203 a week - £85 = £118 reducing his ESA by approx £59.
As for the DLA you should order a form TODAY on 08457123456 and you then have 6 weeks to return it which means you can arrange for help from a welfare rights organisation depending on where you live, you can also ask the OT and other proffesionals for supporting evidence.
The reason I say order today is because any award will be backdated to today so long as you get the form back in time. However many people get a blank form spend ages filling it in and then it is only awarded from the date the department receive it.
Make the benefit claim first and the evidence can follow.
