PCN Single Yellow - Ken & Chelsea Dispute

Hi guys,

I recently received a PCN notice for parking on a single yellow on New Years Day (Saturday), which although IS a bank Holiday, it still subject to the same restrictions as per the day it is..

So that's fine - my mistake - I never knew..

But what I did challenge the PCN for was because it says on their website the following:

"From 1 July 2007, the penalty for parking illegally is £120 for a 'serious' contravention or £80 for a 'less serious' contravention. If you pay this within 14 days, you will qualify for a 50 per cent reduction."

So I challenged it saying:

"where can I find the criteria for what's a minor and major"

In the letter they said:

"...Differential penalties as introduced by the Mayor in July 2007.... Two levels of charging payable for a parking penalty. Differential charging imposed a higher charge on parking contraventions that cause the most disruption and danger to pedestrians and other road users. All other contraventions are charged at the lower rate"

So what I don't understand is how they've concluded it's a major disruption to anything and therefore fits into the major category?

It was perfectly parked (photos taken prove it) on a wide !!! road on a standard single yellow line.. I am 100% confident that it is not causing disruption to pedestrians or other cars, so I simply requested I see their penalty guidelines to see how they've categories this penalty and deemed it a "major contravention"...

Is it worth continuing with the appeal process?

    IMHO YES, every time, even when you don't see an 'out'. I would take a Council PCN to the adjudicator every time, personally, even if I lost at least I would have tried (and caused the Council to work for their 'fine).

    I say this partly because all you risk is having to pay the full (non-discounted) fine, no costs or anything, and the odds are in your favour with not having to pay at all. The majority of adjudications are found in favour of the motorist or go undefended at that stage by the Council. You just have to call their bluffs and bribes (the discounted fine!) and battle on with your appeal.

    But you'll need some help as there may be other matters to appeal on. Post a pic of the front AND back of the PCN (all dates and all small print showing but no car ID and no PCN number on show) on pepipoo forums here:

    Read the stickies & FAQs first to get familiar with how to post pictures etc. Read some other posts about Council tickets to see how the threads pan out and what info you need to give.

    Then register and post there with your pics. Don't post without pics or you'll waste time and just get a reply asking for them! Ideally you also need pics of the line and any signage as well - is it a Controlled Parking Zone, where are the signs and how many?

    All of that info will help pepipoo to help you get off this, hopefully. Most cases there win. :D

    Not sure if it was a CPZ.. I'd have to go back and double check..

    Not really sure what a CPZ is really.. It was just a single yellow line road which is signed (clearly, yes) - "Sat - 9am - 6pm".

    Just that I thought New Years Day, being a Bank Hol, would count as a Sunday, but apparently not! No idea why I thought that.

    But again - what I don't understand is how they've deemed it a "major contravention"...? It's impossible to have parked any safer lol! And I'm not being biased or anything - it genuinely was not a disruption to anything other than the restricted ours. Surely, if a yellow lined road had any potential to cause major disruptions, it'd be a double yellow, or red(s) anyway???

    There's no logic..

    I'll give Pepipoo a shout, but still encourage anyones comments!

  • Regularly on pepipoo there are tickets which charge the higher rate contravention when it should be the lower one, the ticket is often won this way.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
