unpaid employment tribunal award

Hi wonder if anyone can help I won an employment Tribunal back in August 2010 However my former employer still hasn't paid me my money of nearly 5 grand . I have started the fast track enforcement and using an High Court Enforcement Officer (HCEO) .
This is where it gets complicated at the hearing my boss said he was the sole proprietor but now he is saying his brother is infact sole proprietor and now we have a solicitors letter saying this so therefore we cannot seize items from the shop due to the third party claim by the brother i have now sent the enforcement team his home address what chances have i got of getting payment .

Would this not have been checked at the tribunal at the original hearing, not being cheeky, but is there any chance they your boss has transferred the ownership over since your award to try to avoid paying x
