Feeling ripped off by aggressive seller

    When did you purchase the car & how did you pay for it? I would def go down item not as described process in ebay. Or contact ebay. Live help is better but ebay pages are not displaying for me just now to get the link.

    Thanks for the replies, the item no is330033106562. I paid £940 for it, sob!! I will now give him negative feedback if there is no way of "agressively fighting" it, he has already told me that I will get negative feedback in return on a "vice versa" basis(!?) My partner has now contacted trading standards and they are going to investigate and get back to us next week, so I shall see what they have to say. Thankyou all once again, I will update once I hear from trading standards.
  • Actually it looks a lot of car for the money. The description is quite comprehensive so I don’t think you have much to grumble about there.

    Black & white area……Dealers are not allowed to sell un-roadworthy cars. Tyres are either legal or not, if they are legal you have no complaint. The fuel line might make it un-roadworthy, if it does (and you can prove it) you might be able to recover some (or probably all) of the costs.

    Grey area….there are certain SoG things about merchantable quality, fit for purpose, reasonable etc. This is more difficult as it takes into account what you paid, pay 20k for a car and it’s reasonable to expect the seller to fix faults for a year or two…pay twenty quid and it’s reasonable for the seller to do nothing even if it fails within 24hrs. Your 1k is obviously in between, but I wouldn’t expect much, couple of weeks maybe a month.

    Paying a garage to fix the back end could well cost more than the car is worth, just drive it as it is and enjoy (or even fix it yourself?)

    You did go and inspect the vehicle first? You did get an independent inspection done?

    You have had the opportunity to do all this and I suspect you didn't. The car was also sold at auction and via BIN so you mmight have problems there. That is why most folk should by from a reptable dealer and pay the premium they charge you would have more of a comeback in situations like this.

    I recently bought a damaged car and the damage is worse than I thought. But I bought at auction (ebay) and would not feel justified in putting in a claim.

    I am sorry to be so negative, but you really should not buy cars on ebay if you are not able or willing to check it out thoroughly before purchase.

    The one thing I am not sure about is your legal rights with cars and auctions etc and you might want to look at that in more detail.

    Just checked the book price (What Car) on this model and although I imagine this price is a shade high. It is currently worth about £2,800 so as mikey-mike says you got a lot of car for the money!!

    Out of curiosity, why bother fixing it? ok, so it has a ding at the rear, which looks pretty minor in the photos. But we are talking about a £900 car here.

    Just because its 'uneconomical to repair' doesn't make it a write off, or unroadworthy for that matter.

    paul...don't want to nit pick (very much!!) but an insurance assessment of 'uneconomical to repair' does indeed make it a write off (cat c or d) but you are spot on in the rest...it doesn't make it unroadworthy and you can happily drive it round unrepaired.

    Cars I have personal knowledge of include my sisters 02 petrol which cost 4.2k 12 months ago and a workmates N reg petrol which has just been written off (cat c, for the second time!!) and the insurance company paid out 800 and he gets to keep the car (again)

    I think there is something about these cars that seems to attract slow speed rear end bumps

    Oh I have no doubt about that, but that is the sort of price (less a bit) you would pay to a dealer to be able to drive away with a mint car with a decent warranty.

    So assuming a dealer charges £2,000 its still a lot of car for not a lot of money.

    You're right in that if an insurance company were having to pay out on the car after an accident then the insurance company would 'write the car off' as a total loss if it was beyond economic repair to them, ie it would be cheaper to give the insured the value of replacing the car, rather than repair it. The car then is assigned one of four insurance categories for disposal, CAT A - CAT D.

    However, thats not what happened here, the OP got a quote to repair it from a body shop, therefore its up to the person spending the money (in this case NOT the insurance company but the OP) as to whether or not they want to repair it. That has nothing to do with writing a car off as a total loss.

    Therefore the car is NOT a write off.

    For example, the side of my £600 peugeot could do with being fixed and resprayed - there are a couple of nasty dings and some rust. It could cost £1000 to fix it, but that doesn't mean its a write off does it?
  • if he`s a dealer and you have been mis-sold a car then go to local papers. They lap this sort of thing up. Give him notice that your going to local press, see if he pays up, then report him anyway if he`s selling dodgy cars.

    Please note, i said if he has mis-sold and if he is a dealer.
    When things in life start to weigh heavy on your shoulders, and people all around are having a go, just smile and think.......Fxxk em!
