Will I be entitled to housing benefit/council tax benefit if hubby owns a property?

Husband has an ex martial home. He still pays the mortage on it.
Cant sell it as it will attract negative equity so lumped with it.

Lives with me as his ex-wife abducted his son and moved half way around the country. He followed to be nearer his son.

Financially he is screwed and now not hlped by the fact that i lost my job a week before Xmas.

Would anyone know?

    If the former marital home is occupied by his former partner and she is a lone parent, then the value of the property is disregarded for HB / CTB purposes.

    He may want to seek legal advice, if he hasn't already, about paying the mortgage?
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

  • No... He only has a freind looking after it. Can't rent it out cos he cant' get a buy-to-let mortgage.

    Not really...The value of the house is taken into account and as he is in negative equity there is no value. He won't get Council tax benefit on the old house and will still need to pay that or if the friend is living in it for free then the friend should be paying it. Technically even if he has a friend living in it for free he should have a buy-to-let mortgage on it as there is an implied tenancy. But, I won't worry about that here that's a topic for another day. If the friend ever does lose his job then make sure you or he don't get into trouble by setting up a tenancy so that the friend can claim HB. That'll mess things up considerably.
