    As she's being so vague about everything, it would be worth asking for an advisor to sort things out for her. Her local council might have Welfare Advisors or, depending on her age, AgeUK or the Pensions Service will help.

    Buy her a file and ask her to put all correspondence in it so that you can help her keep track of what's happening.

    If you don't think that she has all the paperwork, you could call the DWP whilst she is there - then she can give permission for you to speak to them.

    If you read the sticky thread I cited, you will see that moral/political points and personal opinions aren't allowed on this forum. You need to take yourself off to Discussion Time, where views on the system are welcome. I'd add that it's dangerous to set yourself up as moral arbiter - from many people's standpoint, your views are political, not moral. There is a big difference and that is why these rules apply to this forum.

    So, MIL called the ESA helpline yesterday. Apparently, their records showed that she had gone back to work!! Turns out they have written to a GP at her surgery (not her GP) who hadn't responded to their enquiry and so they assumed she'd gone back to work. They told her than when on ESA, they write to your GP for a report quarterly? Does this sound right?

    Anyway, they're looking into her previous claim to see if it can be reopened again, I think.

    Her ESA award would have said that it'd be awarded until a certain date and therefore she won't need to provide medical notes for that period. But then they'd have reviewed her ESA to find out if she was still off sick. No response would have made them presume that she was no longer off sick and therefore no longer entitled to ESA. I'd be surprised if they didn't write to her as well as her doctor.

    Hopefully now you know what's happening the problem will get sorted quickly.

    As for it not being 'her' GP, what normally happens is they write to the surgery and whoever is the patient's named GP will get the letter. It doesn't matter what name the DWP or anyone else puts on the letter, it will go to the named doctor. This is to ensure that the same doctor gets all the information from different sources so someone has a 'complete' picture and stops one doctor in a practice having everyone's letters sent to them.

    If your MIL doesn't like her named doctor and doesn't want to see him then she can ask the surgery if they can change him to someone else but patients are generally shared out equally so it may not be possible to make the doctor she normally sees her named doctor.
