Help Needed Regarding Car Insurance Claim

Hello all,

About end of november 2010 i was involved in a car accident where i went into the back of another vehicle(nobody was hurt). The condition of the road was slippery but i felt in control of my vehicle and the speed was around 20mph i think. In my opinion it was my fault due to being close to the vehicle in front. I did not admit liability at the time.

The insurance company named quinn direct sent some investigator to take pictures of my vehicle and they found brick dust on the damage on the vehicle and according to the investigators report, My insurance company has made allegations that i drove my car into a wall and they have made allegations that i have done this because i may have had problems with the car. ( as to how brick dust had gone onto my vehicle i have no idea and i am begining to think my insurance company has done this delibratly not to pay me out).

My car was driving great before the accident and my car went through its MOT end of september 2010 with no problems and i taxed my car aswell like in Oct 2010.

I have not drove my car into a wall and the other car that i went into the back of are of witness themselves that i went into the back of them so as to why i was accused of such acts i am now concerned over these false allegations. my insurance company thinks that my claim is a fraud and this is wrong, i have never claimed before and this is my first claim and its not a fraud.

I have contacted a solicitor because i am not happy with these false allegations and i am not happy with the service i have recieved from my insurance company.

Any help or advise would be appreciated or has anyone experienced something similar to my situation?

    I can see why the insurer may have concerns that there is brick dust on the bumper, perhaps they are concerned that the incident is staged or a paper accident.

    I don't really know how your going to explain the situation to them in any other way than you have. Just comply with everything they do and if they try chuck the claim out on the basis they feel its fraudulent they will need to supply you with proof and reasons why this is. Quinn Direct are in hard financial times but I can't imagine they're trying to chuck claims out on the basis of fraud as thats quite a serious allegation

    Brick dust on the bumper?
    I've still got volcanic ash on mine, and sand from the dust storm in summer of 2009.
    I probably last washed it two winters ago.
    The amount of mud and straw dropped on it from the local tractors probably means I must have been offroading and run it into a silo as well.

    If the insurers have got forensic vehicle examiners to look at the vehicles, they'll be able to tell if the vehicles made contact, how many times they made contact and if the damage is consistent with the accident circumstances.

    What about the people in the other car? Did you know them? Have you been interviewed by your insurers or their investigators?

    For them to have decided so soon that they aren't paying out, they musthave done some pretty decent investigations, and there are probably other factors that have led to their decision, for example, claims received from the other vehicle, who they are represented by or who they have had a replacment car from. They'd rarely turn down a claim such as this without good reason.

    Judging by the time scale it could possibly be road grit which could in some circumstances look like brick dust...

    The "Investigators" Quinn normally send out are normally an area manager whose task is to keep claims down, they are often not formally trained in Insurance but are often taken on for their negotiation skills.
  • Firstly Just wanted to say thanks for all your replies.

    I have never claimed before and dont have a history of any claims, this is my first car claim. I only claimed for injury once in 2009 where i was in my friends car and he was driving.

    Regarding brick dust, i can only say that i cant remember the last time i wahed my car i think it was like 2-3 months ago before the incident so it could possibly be road dirt.

    i dont know the other party in anyway and i havent spoken to them since the incident.

    I did not take pictures of the damage like mine or theres at the time because i was in shock and did not know what to do to be honest besides giving/taking name/contact/insurance details as this is my first experience.

    The damage to my vehicle is front bumber damage, both headlights damaged, bonnet out of position and the other party their rear bumber was damaged like cracked in to places.

    From the begining i have felt that i have not recieved a fair service and i felt that they did not want to pay me and now its come to this.

    The decision has not been made as of yet but when i last spoke to my claims handler this is what they said to me.
  • as to why my insurers think that i have had problems with my car prior to the accident, i dont know why. My car was in perfect condition as in no mechanical faults, it went through MOT end of sep 2010 with no problems and i taxed my vehicle in oct 2010. so as to why they have made these allegations i dont know why and i feel i have been lied to.
  • i think the verdict from the investigator of my insurance company with regards to assesing my car is wrong.

    can i take my car to an independant investigator company or can someone assess my car to get a report again because this is not fraud and i cant understand why my insurance company would say something like this even if they think it is but its not.(very weird).

    Any way my question is that i want to appeal against the investigator and i want my car investigated by another company or person can this be done because they reports are wrong.

    Ask for an independent assessor to inspect your vehicle and the third parties to check it is consistent with what has happened. He/She will be independent so won't be working in favor of either of you and should help clear it up :)
