Hi Everyone
It would appear that I have finally come a cropper on eBay. After nearly 150 smooth, pleasant transactions I have been duped!
I purchased a Nokia phone on Wednesday night to replace my Motorola which gave up on me earlier in the week. I followed the usual rules (as far as I am aware), seller had very good feedback for high value items, and had been selling since 2004. I paid instantly with Paypal as required by the auction, and went to bed thinking everything was hunky dory!
I wake up the next day to an email from another eBay member stating that he suspected the seller I had purchased from had had their account stolen. Obviously this got me a bit worried. I immediately emailed Paypal to let them know I'd received this message.
Some time later I got a TKO notice from eBay stating that they did in fact believe the seller's ID had been stolen and that the auction, and my bid had been cancelled. (Shame I'd already paid!)
So again I emailed eBay and Paypal for advice. I received their replies today and have just filed a dispute, which immediately escalated to a claim with Paypal!
So I thought I'd post on here 1) so I could share my grumpiness with you lot and 2) to see if anyone can offer an advice on the likelihood of me recovering my money? I'm not feeling too optimistic!

P.S. I only wanted the phone so my American fiancee could call in the morning without waking the whole house up on the home phone! :-(

I think you will probably be OK. The first thing was to start a chargeback, but I think you might have caught it in time and the guy will not have been able to withdraw the money from PayPal.

What is a chargeback? (Please excuse my ignorance!)
And should I contact my credit card company from whom the funds were drawn?

Normally you would be advised to start an item not received dispute through paypal... but I'm not sure if you can do this so soon after an auction? If you can, do it!
If THAT doesn't work, yes, speak to your credit card people. It's good that you paid with cc funding as that gives you a fighting chance.
By the way, 'instant payment required' can be a warning sign of a dodgy seller. (Not always)My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
The credit card company wont be able to help as the payment was made via paypal. As the payment was made through a third party payment site then it is not covered under the consumer credit act so c/c cannot help.
Best bet is paypal0 -

That may be what paypal tell you, but it's incorrect.My TV is broken!

Always start with paypal but if that fails then go to the credit card company as they are guaranteed to help.
Despite rumours to the contrary you are fully covered for non receipt of goods, not even the £100 limit applies, when you use paypal covered by a credit card. I agree though that this does not apply to all online companies, nochex for instance work a slightly different way and even involving your credit card company is not a guarantee that you will get your money back, it depends on exactly how you paid as there is more than one way of using nochex as payment.

See my post number 7. Paypal do try and pretend there are lots of things you can't do, but in fact paypal terms and conditions cannot over ride UK law.
