ppi why is it taking so long

Hi there
I am trying to reclaim ppi against Alliance & Liecester (Santander) which was misold to me. My case is in the hands of the FOS.
In september the ombudsman awarded the case in my favour, But santander disagreed with the ombudsmans findings. Therefore the case has to be now passed on to the final desision ombudsman.
I don't understand this. surely if it is awarded in my favour thats it.
Can anyone explain?
The other thing is it has taken 2 years & 3 months to get to this stage since i complained to alliance & liecester in 2008.
The last letter i recieved from the ombudsman was on oct 2010
I have emailed the ombudsman but waiting for a response. Is this a long time?
Has anyone had a simlar experiance?

The bank does not have to agree with the Adjudicators decision, so for this reason its reviewed by the Ombudsman himself/herself if it comes to this, or if the decision have been ignored by the bank or loan business who are normally given a timescale of getting back with a decision.
There is also a waiting list for the ombudsman, and with the extremely high volume of complaints, this can take some time.
However, normally if it comes to this and the ombudsman also agree with the adjudicators decision, in my belief you will also be awarded further redress for distress and inconvenience.

D&I is usually recommended by the adjudicator too, not just Ombudsman. But, it cannot be enforced and the firm is not obliged to pay it. Most refuse, if in that case, it will be the usual return of premiums and 8% interest.0

Cheers for confirming this roonaldo, just looked at one of my old cases now and D&I was actually recommended by an adjudicator on one of mine too.
I know one of them was with the ombudsman as well, but thanks for confirming on this one anyway.The one and only "Dizzy Di"

There was £200 paid on D&I on the one that taken almost 15 months, that was a loan PPI via Nemo, that I believe was awarded by the ombudsman's decision, this finally paid out in 2007, and the other was £100 D&I on a Credit card, that I taken out in 2001 and resolved 2 years ago, and was then just receiving my childrens benefits, this one did not go as far as the ombudsman and was dealt with in a matter of a few months by a Adjudicator, well when I say a few months, it was less time than the nemo complaint.
I do know they had to keep on at both of the above, lloyds eventually got back last minute and accepted.
The letter just confirms the amount for distress and inconvenience caused.The one and only "Dizzy Di"

In the same position as you, but different lender, I have though had a letter every month stating that my case still awaiting Ombudsaman, that volumes are high and thanking me for my patience.
Hopefully it won't be much longer now, after all this time though the distress is enormous

Im having same problem but with M&S lender. Have received 1 letter from FOS and it is now almost 16 months from when I first put forward a claim. Very frustrating as I know at least 7 people who have claimed and received money in a 6 month period with no more information or evidence than I have, in fact even less in some cases. Dont understand why it can be so straight forward and quick for some and others have it drag on for months and months.....my financial situation is not good and I really thought by now something positive would have happened ...you are not alone!!!:(

The FOS gives the firm a chance to settle without incurring the FOS fee. So, for those people, it will be quicker. Sheer numbers.
Also - all complaints are different. Different businesses, different issues raised. So don't be too wound up at people getting answers quicker.0 -
It is sheer backlog at the FOS , I think a year ago things moved along quicker and as mentioned some cases more complicated.
I have had only two with the FOS one dealt within 6 months and the current one had been with them eighteen months and was upheld too.
Getting the redress another wait for the first eight weeks and the second still no redress although they claimed to have sent me a cheque 6 weeks ago and still waiting
The FOS have advised to wait 21 days then contact them for non payment if no sign of another cheque although the bank was to pay me BACS originally as they requested my bank details .
So if I do get redress soon say April it will be two years from being with the FOS and three months added from initial start of complaint.Light travels faster than sound.
This is why some people seem as bright until you hear them.0
