Credit Card Rights & PayPal

Just been reading Martin's credit card article with interest, especially the Section 75 stuff. This reminded me about something I've thought about many times…. If you pay for something purchased through Ebay using PayPal, and your PayPal account is set up to charge this against your credit card, are you still entitled to the same rights as mentioned above? e.g. being able to claim against your credit card for goods not delivered.

I have been using Ebay for around 7 years now and having made numerous transactions using PayPal. A couple of years ago I was unfortunate to get 'burned' with a purchase of some new tools from the USA, they simply did not arrive, and several others were also in the same situation. As PayPal has a ridiculous policy of only 30 days 'insurance' and then they're not interested (great if you have to wait to see if your purchase turns up knowing it was sent by Surface mail!!), I contacted Ebay. Well surprise surprise, Ebay wriggles out of this one by stating that they will only make a partial refund in this situation if you send them confirmation that your credit card company will not pay out first!!! :rolleyes:

Well, when I wrote to my credit card company to ask for this confirmation, to my surprise, they actually made the refund to me anyway. I guess they then went to knock on PayPal's door…. as I got an e-mail from PayPal stating that in future I should contact them within 30 days blah blah blah….. ARRRRR!!!! :mad:

So, on this one occasion, I guess I have answered my own question, but have always wondered whether it was a one off, or standard policy now?

Section 75 applies automatically to purchases of over £100 but many CC companies will consider transactions under this amount especially when purchased over the internet.

I guess Paypal got miffed because they lost out on this one. If you claim via Paypal and they can't get the money back from the seller, they could make up some reason for not refunding so they don't lose out. If your CC company gives you the money back, they grab it from Paypal, and if Paypal can't then grab it from the seller, they lose out which they do not like very much.
