Hi all
I got made redundant a couple of weeks ago. I was given my notice pay which is 5 weeks. In the last meeting I had I was told I was being made redundant from that day. In the same meeting I was then told as I was being given this notice pay (PILN) I could be called upon in the next 5 weeks to work, although it wouldn't be likely.
Christmas Eve I got a letter explaining my redundancy pay confirming that I was now redundant from the meeting date. With the same letter was my P45 saying my leaving date is 24th January.
Is this correct? Is my actual leaving date from work after the 5 weeks notice period is up? Just after calling income support they say it isn't included in counting as income, i.e. they ignore notice pay, basically saying it counts as severence pay.
By the way, since my P45 arrived, after querying something at work I had an email which stated I wouldn't be required to work my notice.

With notice three things generally happen.
1) You work it -your date of termination is your last day of notice period
2) You remain an employee but go on 'garden leave' ie you are not required in the office - your date of termination is the last day of your garden leave.
3) You are paid it in lieu (PILON) - your date of termination does not take into account any period of notice (ie it is rather sooner rather than a date weeks in the future)
Sometimes you can get a mix of these (ie you work 1 month of your 3 month notice peiod and get 2 months PILON) but in all cases you should be informed in writing what the situation is.
They appeared to have confused things rather but can I ask, what difference it makes given you know you are not required in? Is it a question of how your previous income is viewed by the authorities in relation to benefits you may now be eligible for?Go round the green binbags. I was wanting to know because of tax credits etc, and to make sure work hadn't messed up again. It's a right mess at the minute because I got laid off without pay, then I got all my back pay when I got made redundant after a dispute, so was still considered employed. Now I've got to sort out money I owe to benefits etc. PITAThere's a storm coming, Mr Johnson. Whats the date on the termination letter and p45(Item4) as your termination date.
This is the date to use.
If they are sifferent I think the P45 can be used unless an obvious mistake0
