Mobile Phone (sim free) return... Unhappy with the product. (Possibly faulty.)

Hey,
I purchased a Nexus S (sim free) yesterday from The Carphone Warehouse and I'm not to pleased with the performance, norr the quality...
I played with the display phone instore and a memeber of staff showed me around it.. seemed pretty cool.
Now i've got it home though and played with it for a while i'm pretty put off...
I'd rather a refund then a replacment or a swap-in...
I still have all the original packaging & receipt etc..

- The phone has trouble connecting to my WiFi, and when it does it'll have a very low signal (even though i'll be sat right next to it).
- The battery life is dreadful.
- The feel of the phone is just cheap.
- And overall, it didn't perform aswell as the one on demo...
I'd rather a refund then a replacment or a swap-in...
I still have all the original packaging & receipt etc..

Unless the item is faulty, and you have bought in the shop, I am afraid you will not get a refund under the Sale of Goods act.

None of what you've described is a fault. Unfortunately you aren't entitled to a refund as you had opportunity to test the phone in the shop.
All you can do is go back to the shop and throw yourself upon their mercy, it's unlikely they'll refund you, but you may be able to swap to another model if you are extra nice to them.
One thing for certain, if you go in talking about your 'rights' (of which you have few) they'll definitely not help you!0 -
You may be in luck, not under SOGA, but because CPW have a nice policy that may help

SIM free phones bought in store- You can swap your SIM free phone for a different handset within 14 days of buying it.
- You can only swap your phone for a different model once.
- You can't return your phone and get a refund.

the fact it feels cheap isnt a fault, the 1 in store will feel the same, you can buy a cover for it as ive done with the desire (basically the same phone)
re the battery life its the same for the desire but you do have options to increase the battery life(maybe if you tried the Battery Life might increase)0 -
