    A friend broke her ankle the day before she was due to return to work from mat leave and she went straight onto the sick until it was healed without issue so I'm pretty sure you can

    I know someone who was back at work for a week or so and then was signed off sick with PND and she was paid her SSP.

    Re the duties - are these normal duties or is this a new thing that you had to do?

    Have you been in touch with the Union and I would also self refer to your Occ Health tomorrow and get an appointment and see them.

    Also, playing devil's advocate, it does seem a bit odd that you probably knew you weren't fit for work, went back anyway as you needed the money and then have been signed off and will be able to get your SSP.

    There is nothing to stop entitlement to SSP once the 39 weeks of the MA entitlement period has expired as long as you satisfy the normal criteria.

    To qualify for SSP you need to have average earnings in the prior 8 weeks of £97.00 per week or more. Statutory Maternity pay is classed as earnings but I suspect (but can't confirm) that MA probably isn't. If you don't qualify for SSP you may be able to claim ESA.

    It also sounds like you could do with some advice around employment law and might want to call (or get your husband to call) the ACAS Helpline on 08457 47 47 47.

    Thankyou for your replies. Theses were not my usual working conditions. It is a brand new campaign. With regards to knowing i wasnt well enough to go back. I completley was, had built myself up and was actualy looking forward to it.

    I planned to returnin november - i wouldnt of been ready then, but i was all psyced up for jan. Thanks for you advise!

    You now know that you will be getting your SSP so hopefully that is a thing off your mind so you can now concentrate on getting better.:)
