    DSR does not apply in this case, there has been more than 7 days since Christmas and bu99er today is the Epithany.

    DSR is 7 working days. Citation from the act itself.

    I don't think OP has stated when it was received, but if it were the [STRIKE]24th[/STRIKE] 23rd then it'd be okay.

    Not to mention the contact made on the 28th could be taken as requesting the cancellation...maybe? If so, then it's okay if it was received as early as the 16th.

    In this case, only the SOGAs apply, and remedy must be sought under that.

    Trip to specsavers due perhaps?

    Under the SOGA the return costs for a faulty item should be met by the retailer, you wrongly said this was not the case and described a factual statement as "Utter codswallop."

    I'll say it again for the afflicted, whilst the user you quoted linked to a document about the DSR, the part they quoted was about the SOGA.

    You've got one thing correct, that the SOGA is the applicable legislation here, but under the SOGA the return of a faulty item should be at the sellers expense, this is not codswallop at all.

    It's all been resolved now. The item has indeed been withdrawn from sale, as they've found it to be substandard. Not that they let the customers that bought one know this.

    After several phonecalls, I spoke to a manager who has refunded the full amount without need to return the item.

    I don't see what relevance this has? She was not playing with it any differently to how a 3 year old would play with it. She was using it as intended - putting items inside and opening and closing the door.

    The only reason the age guidance would be relevant would be if she'd have been using it inappropriately and it broke as a result.

    I think the age guidance is there because of the smaller objects, not because of its robustness applying to the playing methods of someone younger.
