    It usually is. It shouldn't be, but it is. The Police don't like being shown up, or made to look bad, or generally proven wrong - even when they are.

    I always thought flashing your lights to warn other drivers in this situation could result in basically the same penalty for speeding, i.e. £60, 3 points, but having read this I have no idea where I got that from. I did once see someone being pulled for it on Police Camera Action or something similar.

    Flashing your headlights at middle lane hogs - nothing wrong with that I don't think. Making them aware of your presence and desire to pass you. There's a very old video on youtube from the 1950s of a man from the IAM driving a rather nice old jag, giving a running commentary of his driving. Anyway in it he flashes and sounds his horn at someone on a dual carriageway, but then again he does lots of things you shouldn't do now...

  • Cheers for that though from what i can gather his defence was that he was indicating to others that he was going to turn into the layby.

    A bit different to what this chap has done.

    They way I read it is the police were arguing that the lorry driver was "obstructing a constable in the execution of his duty by warning other motorists of the presence of a police speed trap" but the judge said that wasn't the case as there was no evidence that any of the vehicles the driver warned were speeding.

    Indeed but he stated first off that
    The [respondent] told the police that he had been signalling because he had intended to drive into the lay-by but had changed his mind.

    The police made their own assumptions. Whereas this man was doing something different and then tried to argue about it.

    anyway as ive said earlier i agree with the verdict

    Yeah I don't think the recent man made any attempts to lie to the police about what he was doing, however the case that the police brought against him is the same as they tried against the lorry driver.

    Indeed bu the Lorry driver had a defence of he was informing them that he was NOT going into the layby as passing drivers first may have thought he was. This i feel was a decent defence and why he won his case.

    personally....if I pass a speed trap and I see a numpty flying towards it from the other direction...I wouldn't flash my lights, but in fact, smile to myself that another eeejit gets taken off the roads and makes it more safe for me and mine....
    I'm now a retired teacher... hooray ...:j
