Tenancy Expiry

Apologies if this is a slightly stupid question but basically if my tenancy runs until the 26th of Feb (rent paid on 27th every month), if I decided not to renew the tenancy do I effectively have to give a month notice, so 26th Jan, or could I actually decide on the day in Feb not to renew it?

    If you are on a fixed term AST you can simply leave on the final day without giving notice (although it is polite to do so). If your initial fixed term AST has already expired you will be on a periodic tenancy and are required to give 1 months notice.
  • Ours requires us to give one months notice so IMO you would need to give notice (in writing) at the end of Jan. If you don't re-new or give notice you will go onto a rolling months tenancy

    An unenforceable term so your tenancy agreement requires nothing of the sort. A fixed period is a fixed period and a T can leave on the last day without notice, as explained above slyracoon above.
    If you don't re-new or give notice you will go onto a rolling months tenancy
    This part is just wrong. If you don't renew and remain in occupation so much as a second after the end of the fixed period then a periodic tenancy will arise. If you leave before the end of the tenancy then no periodic tenancy will arise. Notice is irrelevant.

    As indicated by slyracoon it is polite to inform your LL when a T becomes certain that they will be leaving at the end of the fixed period.

    Thank guys, as it happens I am planning on renewing our AST but at am keeping my eye out there on other properties on the market, so if I found anything was just wanting to make sure if and when I had to give any notice to leave here....:)
