o2 change in t&c's

I wonder if anyone can help me...

I signed up to a contract in april last year and was told i'd get the unlimited web usage (with fair usage) for the duration of my contract. I got a text to say that my web usage would now be changed to th new 500 mb so I called up o2 yesterday and was spoken to really rudely by one of the customer service agents and the manager!
I asked about the change and was asked when my contract started, so off went the agent and i was put on hold. When she returned I was told that I had changed my tarriff in december and therefore I signed up to the new t&c's. I explained that i hadnt been told this and basically they agreed to listen into the call and get back to me.
In between all this I was told I only use a small percentage of my allowance and asked why I cared anyway! I had a call back today to say they have listened into my call and I would be offered a free bolt on of 500mb for the rest of my contract (i assume - they left a voicemail)

What i'd like to know is whether this means that I can cancel my contract (because o2 have in fact changed my t&c's when they shouldnt have - i think the voicemail proves this)
The way I was spoken to yesterday I just wanted to know whether I did infact have any rights or not.

    As you hardly use any data anyway the change was not to your detriment - AND they have rectified it anyway - you have no chance of cancelling.
  • I dont understand how the amount of data I use has anything to do with o2...as long as I am paying my bills etc on time it's up to me how much i do/not use, is it not?

    Yes. But the change to your terms was not to your detriment, therefore you can not cancel (check your T+C's). AND they changed it back for you. You have zero grounds for cancellation. I can't put it more simply than that I'm afraid.

    There was nothing rude at all - but it seems like you are not hearing what you want to hear.

    They have given you (for free) a bolt on which takes your allowance to 1GB - which is what the 'unlimited' was to start with, right? It was never truly unlimited.

    There's your problem, why did you change tariffs? There'll be an option to resort back to your original tariff, the one you signed up for if you really want to, but if it's a more expensive tariff you'll need to accept that otherwise I'd accept the bolt-on they offered, it's not as if there's an overage charge if you go over your allowance.
  • I've had the same problem. Signed up in Jan 2010, changed tariff in Aug 2010 (which gave me less texts and calls but was £5 p/m cheaper.. they told me I would keep my unlimited data) then the t/cs changed last month and I have gone over my data this month. Called them just a second ago and was told this is the same for all the customers. Asked her if I could cancel but it says within their t/cs they can basically change the t/cs but i'm still in contract and have no other option. I accepted that and then asked to change tariff again for less mins and texts for cheaper. She said this had also changed as I had changed tariff (therefore contradicting what she said before about it changing for ALL customers) and now your only allowed one tariff change per contract. Told her I wasnt happy and asked to speak to a manager. She then came back to me and said they would lower my contract by £5 per month for the rest of my contract as I was told I could do in Aug but I'm currently on a £40 p/m which gives 750MB of data, £35 p/m would lower my texts, calls, and lower me to 500MB of data. Accepted this as my usage is never usually about 300MB p/m (this month must of been a one off) but not happy.

    How come they can change what you've agreed to and it's tough !!!! if you don't like it?

    Also, in reply to Wintermute's comment, I cannot change back to my old tariff as it is now non existant.... =(
    I work for first direct and have previously worked for Santander.
    Any information I give should not been seen as being given from first direct or Santander however I do have certain knowledge from working there.
