ESA Appeal

Hello Everyone,

I have an ESA tribunal date coming up next month, it's not been confirmed yet and it will be at Chesterfield.

The reason I claimed is because of stress and depression and anxiety, I have a Crown Court Trial coming up at the start of next month too, this is why I have claimed, I was sexually assaulted/abuse by my step dad when I was 6 for several weeks and I told the police last February.

I am on/have been on several medications, I am now taking 40mg of Propranolol 3 times a day and 50mg of Sertraline and 100mg of Amitriptyline at night.

Obviously I failed my ESA medical back in July and I sent a letter of appeal straight away and it got looked at again but the decision was not changed. I have been pleading with my GP to try and give me some evidence to send to the tribunal and the DWP but they have not given me anything and time is running out fast.

I have sent them a letter from the Crown Prosecution Service but I have heard nothing about it and they just sent it me back, maybe I will hear something now the postal service will resume tomorrow.

What are the odds of getting the decision in my favour when I go, is there any thing else I can do between now and the start date to help me. I don’t want to be forced to go back on JSA, I am having a hard enough time as it is.

Any advice will be greatly appreciated,

    Do you not have a CPN or psychiatrist that can help you with supporting evidence?

    I dont know what a CPN is and I did not get a psychiatrist referral, I only got referred to a local Counselling service and I am on a long waiting list for it.

    Shall I ask them for a referral?

    CPN is a consultant psychiatrict nurse.

    You can ask for a referral but it is unlikely that you will get seen within the next month.

    The problem is that you appear to have no evidence of your condition. The fact that you are going through a court case is not relevant to your appeal, whilst the subject matter is clearly very upsetting people go through the same process every day and continue to work. You need to look at the ESA criteria and identify the descriptors that you believe apply to you, then go about proving that they do.

    I have a lot of sympathy for you, as I know of someone (woman) that was abused terribly (repeatedly raped, made preganant and suffered an abortion) by her father from age 6 to 14, then he started on her younger sister. That was over 20 years ago.

    She had to appear in Crown Court and give evidence. He was found guilty and was sent down. In all of this time she worked as normal, was bringing up two children and had a husband to consider.
    I'm not saying that everyone is as strong as she was, but from what you have said I don't think you have very much chance of winning the appeal.
    What evidence do you have apart from being stressed.
    I know it must have been traumatic for you, but surely being positive now and looking for a job is far better than sitting around all day with this playing on your mind. You wouldn't want your step father to destroy your life would you?
