thanks guys....
so it doesnt look like im paying emergency tax, the amount i pay a month with only me working ( my partner only works about 6 days a month...we have little boy ) seems quite high my stopages come to over £1200 per month!!
was the bank allowed to refund all my wages ??:eek:I would love to be a Travel Agent :j0 -

It's worse than emergency tax unfortunately. It means you are paying the full 22% on your wages and getting no tax-free allowance nor 10% band.
Although £1200 seems exceptionally high per month - are you earning Over £5,500 per month?was the bank allowed to refund all my wages ??:eek:

I have read else where that this has happened to other people i.e. their employer makes a payment then takes it back. According to BACS this is allowed-

(Direct credits is how companies pay people's salaries into their accounts.)
What does it say in your employment contract? Most contracts have a clause in them that if you are overpaid the company can take the money back. This is normally worded in such a way that the employer can take the money back any time before you cease employment with them.I'm not cynical I'm realistic

I have not been overpaid....under if anything.because of the amount of overtime and call out's I do its hard to keep track of all payments.( I do try and write down all my call outs but unless I put everyone of them onto system I dont get paid, which I know at least 3 last month I forgot to add to the system ) But I think no way were they entitled to recall all my wages without first contacting me. I am off sick at the moment with acute bronchitis, and am worried now what will have over sick pay, my contract says im entitled to company sick pay.
But my contract also states if overpayments are made they are entitled to claim them back.I would love to be a Travel Agent :j0 -
As jem16 has pointed out you are not on emergency tax code your on a basic rate tax code they are not the same thing, if you explain to your company that you don't have another job and they should be using the tax code 503L wk1/mt1 "emergency tax code" then that should bring your tax down.
The thing is if you talk to the inland revenue or your company and say i'm on the emerency tax code they will think you mean 503L 1 not BR you need to be saying "i'm on a basic rate tax code and i only have one job" this should make them realise something is wrong or it would to anyone who knows how to run a payroll system.0 -
Also when they do finally get you on the correct tax code and work how much you have earnt this year and how much tax you have paid if its to much which it definately sounds like it will be you will get it back, as long as they sort it out before next April you will get this in your wages if not then you will have claim it back.0

Just read your post, have you managed to sort everything out now?
I hope so as I was surprised to hear about such a lack of professionalism from you payroll department. If I was you I wouldnt let this rest until I was 110% happy and someone had received a severe boll***ing
Just wanted to reply to a couple of the issues you raised
1) your tax coding
Your last coding had you on emergency tax 503l (M1) previously you were on BR so no doubt you have suffered being overtaxed in recent weeks.
If you handed in a P46 (depending which box you ticked) it would be your employers responsability to correctly assign your tax code until an amendment was issued by HMRC.
If you ticked box A or B and signed the form then your employer has incorrectly taxed you on BR - With this in mind they are in breach of contract by not paying you correctly and on time.
Note that your current month1 basis will not refund any overpayments you have made in tax this just calculates liability on your current earnings.
Push, push and push again for your code to be updated to a culmulative basis.
speak directly to your payroll manager and ask him/her if they are willing to help you rectify the 'balls up' your employer has made - if not contact ACAS
2) Your BACS Recall
The bank are not at fault here as a company have every right to recall a BACS payment it makes.
HOWEVER - you also have a contractual right to be paid the correct amount for the hours worked and for this payment to be made on time. In recalling this payment your employer has once again breached the terms of your employment contract - but its unclear here why this recall was made.
basically from what you have posted your employer needs a kick up the a**e
do you know EXACTLY how much you have been underpaid if not work it out and go direct to ACAS - if I was in your shoes I would be seeking compensation for the breaches of contract here and the distress you have been caused
Get the voilins out and make them pay !!

Thanks sonic.....firstly I spoke to tax office and they are "dealing with it " now to refund tax and get proper tax code.
I am still waiting for my company to sort out my wages,they paid my basic wage, but took away all my overtime and out of hours fee's which totaled about £1,500 .Acas said they are allowed to recall payments!!!GGRRrrr
my area manager came down yesterday and spoke to my boss ( I am still of sick ) and I had asked my manager to call when AM arrives as I wanted to come and see her and ask why I wasnt told this money had been taken back!! she never rang me. ( one of my drivers txted me to say she had arrived!)they say procdures have to be followed and it was far too high !!! NOT A THANK YOU LYNN you have been working 7 days and nights a week...BUT oh she's earning a lot of money...lets get some of that back!! hopefully will find out today how much I will be paid...So will be getting my letter ready to make offical complaint/Grievous.....I will make it quite clear when I go back to work next week...I WILL NO LONGER BE DOING EVENINGS AND WEEKENDS Just do my contracted 40Hrs plus everyother saturday.....I would love to be a Travel Agent :j0
