Ok so we recieved our section 21 on Monday,
We're not on the local housing regisiter and the council have advised us to stay put even after the 31st march. I assume that between the 31st march and the baliffs court order i continue to pay the rent yes? I thought we had to be out on the 31st march but suposedly we dont have to leave untill the LL has gone to court (its a massive company not just a person BTW)
We've been put on band 2 on our local housing list and will go up to band one when the is 28days or less to go, and if we sign up for the other 3 local councils i think we go on a band lower so we would now be 3 and then 2.
What do these bands mean? I assume its low, medium, high and then emergancy?
Slowly getting my head round having to get a 2 bed, needs must and all!Had my amazing little girlie 08/12/2007 - 11 days late! 9lbs 3oz
My second little girl entered the world 20/03/2010 - 11 days late! 8lbs 4oz
Sealed pot challenge 4 - 332
Make £11k in 2011 £0/£11000 - 0%

In addition to all that, what efforts are you making to pull together a deposit for another rental? And have you started looking at other private rentals? Check out if the Council does deposit scheme etc?
if you move out before the bailiffs are instructed, you will be consider to have made yourselves intentionally homeless, so do not do that unless you have an alternative let arranged and paid for.

They've put you in Band 2, so you MUST be on the housing register. Look into how your LA allocate housing. Sounds like a CBL scheme where you have to "bid" on suitable properties. They've given you a high banding, which is an advantage, but it's up to YOU how you use it. From the sound of it, they will insist on a court order prior to offering temp, so time is very limited. It may help to know who your local authority is?0 -

Yep, as I advised you in your other thread you absolutely must continue to pay the rent.
Stay put in the property until either you secure alternative accommodation or the court bailiffs are at the door. As you've been warned, some Local Authorities will not rehouse you and may consider that you have made yourselves voluntarily homeless if you don't stay on until the bitter end.
It will probably take several months for the landlord to gain possession in which time you may have found other accommodation.0 -
Relatives of mine live in 2 bed social housing with 3 children, and have been waiting so long for a bigger place that the oldest 'child' is now an adult. Personally I wouldn't want to take the homeless route into LA housing as this often means being put in a less desirable area. I would definitely be thinking about a Plan B. Good luck!0

I would go the 'council' route to begin with - it's often sheer luck where they house you.
If you don't like it, you can always then go into a private let.

thanks everyone, I will continue to pay the rent. While the court make us pay the court costs?
The council said they might try and make us pay but I am not sure what happens then or how much it is, Caseworker has spoken to the agent as I think most of us spoke to the council, i know both my neighbours are on benefits. Probably - if the LL asks the court to make you pay them - but it is not automatic. If you make a submission to the court outlining the council advice then you may be lucky and avoid a costs order.0
