Tesco Clothing and Footwear - returns policy??

Can anyone advice...

I bought a pair of boots for my sister as a present from Tesco Extra (Wembley) last week. As they were a present I removed the labels. The boots were not the right size so I took these back with the receipt.

I was told at the store that I could not get a refund as the boots were not in the original condition (labels were missing). Apparently there are notices in the clothing department. I spoke with the manager who said the same thing to me the returns policy is on a small notice no where near the shoe department. I was not told about this policy at the check out on purchase. I have checked the receipt which only mentions the return within 28 days policy and no specification of the different policy for clothing and footwear.

I am now stuck with these brand new pair of boots that Tesco will not refund because of missing labels. Is this right?

If anyone has managed to overcome a similar problem can you let me know please. I am quite shocked with the response.

    Can you not just stick or tie the labels back on?

    Or perhaps you could sell the boots on ebay?
  • I am afraid that the Sale of Goods Act does not give the right to a refund as the goods are not faulty, you are at the goodwill of the retailer
