Help in concluded resolution case for an ebay novice buyer

Hi,
I recently purchased an item that I claimed was not as described, and after several exchanges of negotiations, via member emails, I opened a "case". The seller subsequently argued that although he had accidentally clicked the "returns accepted" button he requested a variation in the contract on the premise that he believed the goods would not be significantly returned in the condition he sent them.
He chose to escalate the case and the resolution centre have mailed me to say they have provided me a full refund.
The seller responded immediately by issuing threats that if I do not return the item in the next few days he will take legal action.
I would be more than pleased if a commissioner could verify the condition of the goods, to protect myself, prior to them being returned.
Does anybody have any experience of this type of situation, notably an incredibly angry seller

Did Ebay say you had to return it? It doesn't sound like it.
I would also ask for postage back/returns envelope. If that fails and results in more threatening emails, ensure you have the seller blocked on your BBL and ring Ebay and explain what they are doing/saying.0 -
If you was refunded without returning the item, the buyer may not have lost out. You get your refund and buyer gets to keep money.0

Sounds like a no fault refund. Ebay have refunded you and the seller has not lost out, otherwise you would have had to send the item back, provided tracking and then been refunded.
Juts ignore them now, you've no worries.0 -
I would reply saying you were under the impression that this was a 'no fault' refund and that they seller had not lost money.
However if you are wrong and ebay requests that you return the item you will do so at once.
(as they won't... you won't)0 -
Not a bear was it?
Just a thought.
As everyone else says, keep it if ebay haven't asked you to return it, it does sound like the seller still has the cash for it. Ignore any direct emails, or refer them back to ebay.0 -

Hi and thanks everyone, here is the essential content at my ebay resolution centre:
I am interested that the seller is demanding the goods back despite your suggestions that he may not have had a deduction from paypal.
You don't need to do anything else.
Customer support has refunded you through PayPal and the case is closed.
Refund information:
We have issued a refund of £XXX.00 to the PayPal account you used to purchase this item.
Final decision:
Neither you nor the seller were found to be at fault.
Customer support comments:
'You will be issued with a refund.'
Essentially paypal have refunded me and, it may transpire at your suggestions, not at the sellers expense. Presumably an attempt by ebay to keep both our custom. However I am not convinced that this is sufficient to encourage me to ever use ebay again. I certainly would never use it for anything of value. Far too much aggravation, best to just leave keen ebay sellers to sell to each other and argue amongst themselves.
I will wait a little longer and see if he attempts to follow up on his threat.
new year cheers for all your help.
thanks again

Yes definately a no fault, good news for you and the seller.
You could reply saying ebay have found neither at fault and you suggest he takes it up with them, then cease all communication. Seller cant leave you neg feedback or anything so you're ok.0 -
Yeah thats definitely a no fault claim. I've just had a case closed against me. The buyer "won" the case, but the refund came from eBay not me. I don't expect the item back.COMP WINS FOR HUBBY & I SINCE SEPTEMBER:2 £50 DOMINOS VOUCHERS, 13 PAIRS OF FOOTBALL TICKETS, MICROSOFT HOME EDTN, 2 PAIRS OF ALTON TOWERS TICKETS, 1 CASE OF PERCY PIGS, 1 PAIR OF LEATHER LADIES GLOVES, 4 COLLECTION 2000 PRODUCTS, PLAYSTATION 3 WITH FIFA 12, 5* HOTEL STAY IN LONDON, SEASON 6 OF SUPERNATURAL DVD, PERFECT PIZZA VOUCHER0
