Section 75 - Retail Store

Hello,

Just out of pure curiosity, is it possible to get a refund from your credit card provider if it's an actual physical shop that you purchase from? e.g. you walk into Argos and purchase a mobile phone, it doesn't work and they refuse to refund your money. Could you claim a Section 75 refund from your card issuer or does it only apply to online purchases?

    It applies to all purchases of £100+. The legislation pre-dates internet shopping.

    Absolutely true.

    In the example given, however, the phone itself would need to cost over £100. If the phone was "free" on a monthly contract with a minimum term, s75 would probably not apply. Unless anyone can prove me wrong??

    I feel only slightly stupid now considering that Section 75 is from the "Consumer Credit Act 1974" which will obviously pre-dates the creation of web browsers, however I suppose I can still claim confusion on phone order grounds! :P

    No don't feel stupid. Statutes often amend earlier statutes - sometimes to the point where there is little of the original left. So in theory it is quite possible to have a 1974 statute that refers to internet selling!

    Incidentally, the 1974 Act was significantly amended by the 2006 Act, though I'm guessing s75 was in the original Act.

    Section 75 is changing in Feb 2011, well there will be section 75a which may offr dditional protection.
