            LONG STORY SHORT>
Early Dec I had some bad press in a national paper. All of it lies.
<I work is a homecarer, when my bosses saw the paper they suspended me from work.
Reason was, they said 2 people’s houses I go to were effected by the press hounding me. I know for a fact that one has mental health problems and loves a drama so made thing far worst than they were. The other really didnt care and she said I know its lies.
Basically because of this work suspended me pending investigation.
23rd Dec they said they were doing me for Misconduct, and said they would take a few day to decide what they would do. In the meantime the office were to put me back on the rota if some work came up, It did 20mins later 4 hours work, then nothing for 6 days again 4 hours work
How am I suppose to raise a family, pay a mortgage on hours like this?
If I leave the job, my contract is for 0 zero hours says I have to give a months notice?
I cannot live on no wages
What do I do.0 -
What was the bad press about, shoddy care? BTW, not being judgemental as 99% of what is in print is a lie anyway.0
 -
OP have they still to inform you officially of the outcome of the investigation?
If so you will need to bide your time and then when you see the result decide whether you wish to appeal against whatever has been decided.0 -
The months notice is unenforceable in practice, so if you choose to walk then they'll probably do nothing about it.
However at the moment, any reference is likely to ask if you have any outstanding disciplinaries against you, so looking for a job in a similar field may be difficult with a misconduct charge hanging over you.
I can't quite see though how you can be suspended and back on the rota for overtime - doesn't make sense.
Also, (in my inexpert opinion) if your contract is for zero hours, and purely for relief cover (which is what it sounds like) they're not treating you unfairly by not giving you any hours, if they're not there to give. Relief staff cover as and when required, so if you're not needed, there's nothing you can do about it.
Edit - have you got hold of a copy of the disciplinary procedure, as that's the first thing you need to do? Also, if you're in a union, get hold of your rep.All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.0 -

I was a full time work 40 hours per week and had been promoted but the press release stopped them from giving me the hours. Everyone who works there is on 0 hour contracts.0 -
Surely this other job must bring in some money...
But anyway, what would you do if you were made redundant? Or the employer went out of business entirely? You can't rely on always having a job. The path to losing a job is in a way irrelevant, as your main questions seem to be how to raise a family and pay a mortgage on no income. Rather than asking about a possible unfair dismissal claim?0 -

Then I would suggest contacting ACAS to see where you stand - it may be that if you've worked a minimum number of hours over a certain time, then it may be considered as contractual. How long have you worked there, and how long have you been doing a regular 40 hours for?
Then when it's sorted look for a job where you have proper contracted hours, and not a cowboy employer. All shall be well, and all shall be well, and all manner of things shall be well.
