    Good points. Wow these people even go to the lengths of solicitor's letters & debt collectors (They don't turn up at your door do they??).

    The chain is parking company then debt collector which might be the next desk on the left or could be a different office, then debt collector to solicitors which may be the next desk on the right or a different office. The truth is they are the same company or all work together selling each others services for peanuts. Its just basically a letter chain. Trying to intimidate.

    Solicitors letters are often bought for about £5 a go from firms that sell a 'letter before action' This enables the parking company to use a solicitor's letterheading to intimidate you. It uses phrases like 'may take action'. These letters, like those from the PPC are meaningless. Debt collectors do not have powers of entry or siezure, that is the domain of court-appointed bailiffs. In the very unlikely event of a debt collector turning up, I suggest you give them the sort of advice given by Gordon Ramsay. If you are called, leave the phone for a few minutes without saying anything and then hang up.

  • here’s my story…any advice would be very much appreciated!

    I got a ‘parking charge notice’ for parking my vehicle past the time notice. I think I had overstayed by 20 mins. The amount I was being charged by LDK security astonished me so I looked on the internet and I stumbled across another website which had letter templates to send off to the private car parking company – so I sent off a letter saying the following:

    You issued me with a parking ticket on 14 August 2010 but I believe it was unfairly issued and I will not be paying your demand for payment as the fine is disproportionate.

    According to the Unfair Consumer Contract Regulations, parking fines on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the £60 charge you are asking for far exceeds the cost to the landowner of £0.50p for 1 hour. I would need to have been there for 120 hours to justify your sum.

    If you choose to pursue me for this fine please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you respond to the specific points raised in this letter.


    On Monday 15 November I have received a response saying they reject my representation against the parking charge notice and my vehicle was illegally parked, and I consented to the risk of being issued a parking charge notice by parking my vehicle past the time limit.

    They state that the car park is regulated by the contract conditions displayed in the car park and by implication I entered into a contract with LDK security or the landowner and I accepted the terms & conditions that apply by leaving my vehicle at my own risk.

    They also state they operate under the BPA approved operator scheme and code of practice for parking enforcement on private land and unregulated public car parks as issued by the british parking association and the charges are not deemed unfair by law.

    Failure to comply in sending payment will result in my details being passed on their debt collection agency and the issue of court proceedings without firther warning whereby extra cost will be incurred. Photo’s maybe sent and they will not enter into multiple appeal processes.



    i ignored this after reading advice on various websites.

    i have now received a letter from EDRS stating that my debts has not been paid. also, the letter from EDRS now titles it as a civil parking charge notice and requests payment within 7 days for the full amount 'as stated above' - yet there is no amount stated on the letter.

    i cant afford to pay the sums they want me to, but it is quite threatening and scary.
    should i continue to ignore? or should i offer to send a cheque to cover the loss to the business (50p!)


    Please help!!

    What help do you need other than to just ignore the prats. The chances of it going further than threats is less than the chance of you winning the Euromillions.
    Just file and forget. There is nothing to be worried about, there will be no court, no CCJ, no effect on your credit record etc. Its all empty bluff and bluster.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • Do not waste any more time and postage writing to these people, as you have found out there is no such thing as an appeal. You are taking them far too seriously.
    From now on just ignore, they will give up after a few more letters.

    A few things you need to know:

    The BPA is not a regulatory body, it is just a club run by the parking companies for their own benefit.

    Photographs prove nothing.

    The whole private parking industry is run by people who wear stetsons, ride horses and go "YEE HA"

    These companies never go anywhere near a court, so don't worry!

    you would have been better ignoring them, and others will be along with further advice which will mainly be to ignore. look at the forums on pepipoo also don not reply to the letter.
