Motorists will be slapped with £80 fines and the company may take them to court if they refuse to pay.

Richard Dobble, 35, of District Enforcement said:
Using our knowledge of contract law, we've come up with a solution which is legally water-tight and fair.
and went on to explain that it relies on penalty tickets to drive home the message.

My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

"District Enforcement has now been awarded approved operator status with the British Parking Association and has also won the backing of Mobilise, the charity for disabled drivers."

Is that the Norwich Pharmical Order perchance? There is a document regarding their development here:[PDF] Download - K Norwich Pharmacal orders over the last 20 years

Normally the applicant (ppc) would have to pay the costs of the defendant(RK) but there is an argument that the Totalise case gives precedent to recover the cost of the order from the wrongdoer (driver), and the RK may be an innocent party. : http://www.out-law.com/page-8699

The costs could spiral out of control like a neighbour boundary dispute, and in view of the triviality of the tortious liability of the wrongdoer the order may not may not even be granted, on the triviality of the sum involved. legal fees in the thousands against a claim for 80 quid recoverable from the driver? the law would truly be a donkey (three letter word meaning donkey is censored here !!!) One cannot put the law is an A*S
    .

    there is more info here:

    http://www.inbrief.co.uk/civil-court/special-disclosure-orders.htm

I feel this would be the sledgehammer to crack a nut, and if seriously pursued by a ppc for a penalty charge of £80, itself contractually dubious, a judge may spank them severely.

  • Some good comments after the article.
As soon as I find out which car parks they are "policing", I will take great pleasure in proving them wrong!

  • This bit was brilliant

Since when did anyone apart from councils and police have the right to do just this

Ive just noticed that they have now changed the piece so it doe not show double yellow lines. And access routes.

    anyway fired off a letter
    To Maria Scrivens

After reading your piece in the staffs university website i could not help but laugh. Could you please forward to me the contract law which quite clearly states that your company has the right to issue non enforceable tickets to anyone who you deem is parking illegally according to your rules?

And also why did you deem it necessary to change your original statement which included double yellow lines and access to something different? These pages are cached unless you can prove this was a mistake.

Also can you please prove to myself just why you think that your warning signs should carry the chequered motif of the police? You are not authorised by the police and i feel that these are scaremongering tactics to get unsuspecting members of the public to pay your extortionate fees which you claim in your press release to be cheaper then other companies yet are a lot higher.

Also I would appreciate it under the freedom of information act if you could give me the details of court cases that your company have won through perusing non payment of your alleged parking notices

    Many thanks

However, the This is Staffordshire article retains the detail:
Their prime targets will be drivers who park on double yellow lines, hog disabled parking bays when they are able-bodied, and block access routes.
