Distance selling regulations and food -

  • Isn't that a bit like stating that M&S didn't inform you of the alcohol licencing act, and because of this you are entitled to a refund on the chicken?

I know this sounds stupid as the licensing act doesn't apply to sales of chicken, but in effect this is the same as the DSR's and your purchase.
The DSR's don't apply to the sales of fresh food, so there is nothing for the retailer to advise you of.

I suppose it depends on who you think the DSR are there to protect, businesses or consumers?

try and order a bottle of champagne and it is made clear on that very page that you have to over 18.

I am just surprised that a big company like M and S don't make it clearere on their food pages that a) You can't cancel once ordered or I couldn't and b) if you don't collect you only get 50 % back ?
It wouldn't take up much room but may be it would make some customers think twice about buying and I don't suppose that they wouldn't want that would they?

If shops can't deliver because of the weather, as I found out with on line grocery home delivery grocery shopping, its just tough luck on the customer but if the customer can't get to the shop bceause of the weather, its still tough luck to the customer.

As I said only 6quid so I'll get on with enjoying the rest of christmas.

But the big difference is that if a shop can't deliver due to the weather, the customer doesn't lose out financially but the shop may well do as they might end up with out of date or unsold food so the shop takes any loss in this instance.
If the customer can't get to the shop to collect pre-ordered food, why should the retailer also suffer this loss as well?
